Got a Issue out of nowhere! help please

Hi Peeps,
I got a Issue and need any info or advice please, I'll keep it as simple as possible.

1. Ok, I had a son in 1994. We (parents) separated. Had a CSA thing set up ..no problem.
2. 2004.. My Ex re-marries and has 2 more children and the father adopts my son. Then they all move to Dubia.( still there to this date)
3. Now I heard nothing from 2004 until 10th Feb 2013 with a letter from DWP stating that deductions in my JSA claim(which I only had for 4 months) of weekly payments of X amount.
4. I called DWP they knew nothing of this deduction, I called EMEC, They knew nothing of this letter or case. I called CSA.. They said was a case opened from 1994 and they will look into it. I must say that the letter from the DWP received today say's nothing of what the payments are for! (Date from & to). It just says for child maintenance, payment dates start to indefinite end. Outside the EU?? adopted.. I'm I missing something?


I'm confused. Is this just a computer system hissy fit??

    is the payment £5/week - £10 fortnight?

    was the PWC on IS before (2006/2008 forget which)? if so then a debt might be owed to the sec of state... and still repayable to "him".

    if no debt, then not sure... if payments have started, did you inform CSA when child was adopted... and when they left the country.. (in writing)

    if not, you may of been "owing money" until you notified them (today).
  • I think it's likely the CSA are missing something. Dig out your copy of the adoption paperwork and either send it to them by recorded delivery, or take it to your local DWP office (probably a Job Centre) and get them to do a certified copy for you which you can then post. The CSA can only deduct a max of £1 a week for arrears and only from certain benefits. If it's more than that, your case is still open and you will need to address that issue.
    I often use a tablet to post, so sometimes my posts will have random letters inserted, or entirely the wrong word if autocorrect is trying to wind me up. Hopefully you'll still know what I mean.

    Sorry I should have clarified it a tad more clearly :)
    I'm the Biological father, The Mother remarried and moved to Dubai in 2004, The Mothers new spouse somehow adopted my son without my consent or knowledge (so the mother's brother said so, whom I'm close friends with still). Cut a long story. Things we're bad back prior to 2004 and it was disrupting my son's school progress as he wanted to see me more than I could, As we lived opposite ends of London. There was a amicable decision to let the new step dad in his life assume the role creating a more cohesive family unit, Was sad at the time but was for my son's benefit at school etc. I believe It paid of as he now is in University in Dubai. anyway. So We settled the CSA rate from 1995 to when they disappeared. All Stopped!. Mother and new family unit left UK and EU. Me, Biological Father left in UK.Never ahd 1 letter from them since 1998 approx, Had Zero from CSA to this date with only a letter about ongoing CSA payments starting from 5th feb 2013 to indefinite. of £7.20 a week. I since.. (gets more confusing) was civil partnered in 2011, since then my partner was made redundant etc.. and we now both just started a JSA joint claim.. Subsequently letter arrived. Now Im just awating a official response from CSA about the issue. I just wondered if anyone had any solid knowledge about child/mother outside the EU and CSA still being able to try and chase me. effectively for something that is not valid??.

    Ps. The recent letter states nothing about arrears.

    but he couldn't have adopted the son without your written permission. so it is possible you owe CSA payments

    I suggest that you need to get your file (Data Protection request) and find out exactly what is in there.

    I also suggest that you may have been lied to about the adoption (you would have to formally consent). Sadly not unusual for mother's to do that.

    You need information about when they went to Dubai as you need to close the claim. Whether you can unpick the past debt is another matter.

    When the PWC left the UK and started a new life in Duabi the case should have been closed.

    OP from the time you separated until the time your ex left the country you would have been liable for child support payments. More than likely they are due to the SOS and not the PWC.
