Hi Can anyone help me.
I am currently residing in a property that my ex husband (not divorced) and I Jointly own. I am in the process or really need to go bankrupt. I have a new home from the council, and I start tenancy next week. He has no interest in the property and will not move into the property. He walked away almost 2 years ago and has not paid a bill or the mortgage.
can anyone tell me
A. Can add the property to my bankruptcy order?
B. if I go bankrupt and not add the property what will happen?
or just give me some good general advice. I have a loan in my name secured on the property, I am redundant and claiming JSA. I have 2 dependent children.
Thanks in advance.

Good news (for you) not so good news for your ex.
Bankruptcy only deals with unsecured debts, but as soon as the debt becomes unsecured (even years later) then any shortfall is included in the bankruptcy.
You include the property and mortgage in your paperwork. If there is any equity the OR will force a sale. If there is no equity and no one is paying the mortgage the lender will eventually repossess and chase your ex for the shortfall. They will not be able to claim off you.0
