Hi,
Can you help.
I just had a letter from the council about council tax on a property I sold over a year ago.
They are saying I had a refund for an overpayment (about £2000) in 2008 but apparently (I havn't checked) due to their mistake they sent me the same overpayment in 2010.
They are asking for it back, where do I stand ?

If the refund was made in error then they can request it back and take action to do so (by the county court if need be). For £2000.00 I would suspect they will try and push the issue - it does though show a rather large error in reconciling any refunds. They are saying I had a refund for an overpayment (about £2000) in 2008 but apparently (I haven't checked) due to their mistake they sent me the same overpayment in 2010.
In the council I worked for the refunds went through at least 3 separate sign offs before being issued and I must be honest and say that I don't think I've ever seen them double pay a refund.I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0
