    council tax Ref: Account No: 123456 and 346821
    Bailiff ref : Account No : 34692 and 18932
    Dear Sir

    You contractors Ross & Roberts have been instructed to enforce the above accounts
    There Bailiff Mr xxxx has Failed to abide by The National Standards For Enforcement agents January 2012 by not providing me with a breakdown of fee charged on (date)
    the notice of Seizure/distress states Bailiff costs. £292.50 with no breakdown of how he has arrived at this amount

    xxxx council confirmed during a phone call on (date) the liability order amount for 2012/13 is £1036.30 however the notice of seizure states Amount owing council tax. £1243.11 this being a difference of £206.81

    The notice of seizure /Distress states Total amount payable. £1538.61 however the receipt i received from bailiff on the same day states Amount paid. £120.00
    O/S Balance. £1779.30 Costs. £292.50 this being a difference of £360.18 against the notice of seizure/distress total amount payable of £1538.61 if you include the £120 payment that was made

    It would also appear that the goods levied for account(put account no for 2012/13 here) are still subject to a previous levy by Ross &Roberts for account (put account no 2011/12 here)

    There are several financial discrepancies with above accounts before i can take this further i request that xxxx local authority provide me with a full audit of both accounts

    This includes:
    a - the time & date of any Bailiff action that incurred a Fee.
    b - the reason for the fee.
    c - the name(s) of the Bailiff(s) that attended on each occasion a Fee was charged.
    d - the name(s) of the Court(s) the Bailiff(s) was/were certificated at.
    e - the date of the Certification.
    f- all payments received by Ross&Roberts to include date payment was made
    g- all payment received by xxxx council from Ross &Roberts to include the date the payment was received
    h- the amount and date of each liability order

    This is not a Subject access request under the Data Protection Act S7 1998 so does not incur a fee of £10. You are obliged to provide this information.
    A copy of this letter /E-mail has also been sent to Ross & Roberts
    I require this information within 14 days.

    send this to the revenue's manager of your council with a copy to R&R if you are sending it by post send by recorded delivery

    your council may use a back office provider for the collection and enforcement of council tax one of these back office providers is Capita who just happen to own 2 bailiff firms and yes you guessed it one of them is R&R so its important to keep every in writing by either recorded delivery letter or e-mail

    Enforcement agents will on each and every occasion when a visit is made to a debtor's property which incurs a fee for the debtor, leave a notice detailing the fees charged to date, including the one for that visit, and the fees which will be incurred if further action becomes necessary. If a written request is made an itemised account of fees will be provided.

    Outstanding council tax is £1036.30 for 2012-2013.
    LEVY FOR 2012-2013 states.....
    Amount owing council tax. £1243.11

    there should be no difference on these 2 amounts

    The reason for this is usually either that the bailiff haven't been advised of a change of circs or a payment which has reduced the balance or the bailiff have quoted a total figure which includes costs.
    I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.
