Hi. I could really do with some advice as to how to sort this out. I will try and explain everything but my apologies if i miss anything out.
Back in 2011, i had a bailiff come to my home for outstanding c.tax.stupidly i let him in and he took a notice of seizure etc and i paid in total £1353.69 up to October 2012. The same bailiff knocked on my door saying he needed to come in to talk about that bill so again i stupidly let him in. He then proceeded to tell me that i had the c.tax bill for 2012-2013 to pay( true but was not aware it was with them and was really struggling to pay both at the same time).
He was very intimidating and was asking if i could pay the last of 2012 bill as well as some of the 2013 bill. I said no and he then continued to write out a notice of seizure for 2013 bill.He told me i had to pay at least 120.00 that day so i did
To be honest i didn't know what to do and he left me with the paperwork and told me i had to pay 120.00 per month thereafter.
Forward to this month. I have been paying as asked on the 5th of every month but on the 5th of this month i couldn't get through so on the 6th i managed to get through and explained this to the lady. She said not to worry and just pay so i did. For some reason the payment would not go through so she told me she would ring back to let me know.....this did not happen. The following day i phoned and was told to check bank statements and if it hadn't gone through to phone back and try again. After checking statements it was not showing as paid so phoned to try and pay again. I was told that i could not pay and to phone the bailiff who will decide if i can pay!:mad:
I'm really worried now as this was not my fault and i feel as though they are going to add more money now. I don't want to speak to him as i felt uncomfortable last time.
Upon looking through my paperwork that was left both times, it seems as though i have paid too much for the second bailiff costs as the 1st one was £138.00 and the second was £292.50.
So sorry as i have gone on but i don't know what to do.
Please if anyone has any advice.

I don't have any knowledge or experience of your problem and am unable to advise.
Thought I'd give your thread a bump as it is almost down to the third page on the forum without reply.
CAB or National Debtline might be able to advise on your situation. Possibly with support for setting up a payment plan and advice on whether bailiffs are acting correctly, lawfully and within the regulatory framework. Give one of them a call.

Thanks for the advice. i will give them a call this afternoon when i have finished work. couldn't sleep last night with worry.

As a starting point, you need to contact your local authority and find out how many liability orders have been obtained, for which years and for what amounts. There is also a limit to the amount that bailiffs can charge you.
There is a poster called Hallowitch, who is very knowledgeable about what bailiffs can and cannot do. I may be worth sending a PM to her.
Would also second contactin National Debtline or CAB. hth0 -
get in touch with the the council and ask
1 - how many Liability Orders they have against you
2 - the dates they were obtained
3 - the addresses they were for(if you have moved house)
4 - the period of time each covers
5 - how much each one was for
6 - how much is still outstanding
7 - the dates they were passed on for enforcement
8- the amount of each debt that was passed over to the bailiff firm
you also need to ask if there is an outstanding balance on the debt for 2011 that is being collected by the bailiff
If there is no balance you need to find out the date the liability order was satisfied
do you still have the notice of seizure from 2011 can you list the goods levied on this and on the notice of seizure for the 2012/13 yrI am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

I have the originals of the notice of seizure and inventory of goods paperwork that was left both times. The kinds of things listed were(as written), teak table, TV unit,wall unit!!!
my furniture that he put on here would never reach any of the amounts needed.
i have not got a clue why there are two different amounts on bailiffs fees but i think he might of added one liability to the other and maybe its from that?
I am so sick from the fear of him coming today that i am planning on going out. ridiculous i know! just want this sorted. I have no problems paying what i owe but feeling threatened and sick over this is not something i thought i would feel. Too many powers these people have.0 -
don't live in fear because of the bailiff
what bailiff firm is it you are dealing with
the bailiff doesn't want your goods he wants your money goods levied must cover all bailiff fees to include removal , storage,auction fees and a portion of the principle debt
If you have outstanding balance against the 2011 liability order then they cant levy the same goods against the 2012/13
can you list the council tax debt outstanding and the fees charged for both debts as written on the notice of seizureI am not an expert I am self taught i have no legal training any information I post is based on my own personal experience and information gained from other web sites

ok i have phoned the council and managed to find some of the information.
1 liability order but i know that when he did the 2012-2013 order there were 2 orders. I think £20.00 left on the 2011-2012 order.
2012 order taken out in June of that year.
Outstanding council tax is £1036.30 for 2012-2013.
The lady does not know when 2011-2012 bill was satisfied but i know as stated above i had nearly paid it when he came for 2012-2013 on the 09-20-2012.
the lady also ran through monthly amounts of how much they were paying the council.
oct- 102.00
nov- 21.69
dec- 86.81
jan- 120.00
goods listed are very similar except for 2012-2013 they didn't put my car on there.

Hello
Can anyone tell me whether one is obliged under law to pay for the cost of a summons for non payment of council tax even though payment was made although it was a bit late. The cost of the summons is £80 and since my council tax is now fully paid up the council has told me they will ask the court to issue a liability to force me to pay for the cost of the £80. I find this harsh and unfair. Can anyone enlighten me as to my rights.
