Sacked with no Warnings after 13 months service?

I thought they weren't allowed to 'hold it against you' for taking emergency time off for dependants illness, especially if you actually worked from home instead so you weren't actually absent?
And although I'm in no way an expert but I thought they had to 'manage' sickness in the sense of holding meetings if they were concerned and then warnings etc?
I could be wrong though!0 -
Op,I know you said 15 days but how many different occasions were they?,
was it 15 different occasions or less? and how many of these days did you work from home?.0 -
yes 'persistent absenteeism' was deemed as 'gross misconduct' and the 15 days were not part of my annual leave.
That's quite a few days on top of your annual leave.
What was the make up of the 15 days? Paid/unpaid. Sick/emergency dependant leave etc? Working/not working etc...Sanctimonious Veggie. GYO-er. Seed Saver. Get in.0 -
I think it was 8 or 9 occasions and they recorded every one as unpaid leave. They did not record it as working from home.
I took one day annual leave throughout my employment.
I think the problem stemmed from us eing bought out by a bigger company and once they saw my absence records they struck me off at their first opportunity.
This is just a shot in the dark to be honest. I was 90% sure I was not entitled to complain about this but I thought I'd ask.0 -
Why unpaid leave?, would they not allow you to take some as holiday?,
I know all firms have different policies but I would have thought that if they were dismissing you for this surely it would be unauthorised absence as unpaid leave suggests it has been agreed,

When is the holiday year? they need to pay the acrued unused holiday.
why did you not use holiday for the emergency leave?0 -

Time off for looking after your children is not usually given as such. Time off to arrange child care for your children is the general agreement.
The fact that this took place a number of times would raise concerns.
From previous posts you said that you only had the children at weekends. Has this changed or were you doing the children's mother a favour by looking after them?0 -
I only have children on weekends so they are not my dependants but my previous partner was ill (a few times) so I was doing her a favour really.
The absence were mainly unpaid leave in the way that I asked my manager if I could leave to look after kids and he said ok.
Some were authorised absence where I self certed or got a doctors note.
I was shocked mainly because I was given a pay rise for good performance at work, then when the work died down they got rid of me the first instance I was off sick and got a cheaper replacement.
What is the maximum allowance for sick leave within one year.0 -
Why on earth didn't you take them as annual leave?Sanctimonious Veggie. GYO-er. Seed Saver. Get in.0

they would not allow me to. I asked plenty of times but they just wouldn't let me.0
