That wasn't really the point - if you do need to get through a barrier then obviously an Oyster card would get you through. And if there is no barrier, as on the tram, and at some stations, then you just don't bother.

It's not clear if you're suggesting the OP boarded the train without bothering to touch in or advocating the none of us should bother.
If the latter, then that's no different to picking up stuff in the shop and walking out - apart from the layout of checkouts in the supermarket no shops have barriers so why bother paying?!

Hello i am in the same boat as you. Except my fine has excalated to £110. Sinply because i did not have my photocard at present. I suggest that if you have witnesses then you should continue to appeal. But if the evidence is not strong then pay up0

Unfortunately witnesses or no witnesses, the offence was still committed. The idea of the Penalty Fare is to resolve the criminal matter of not having a valid ticket, in a civil way so as not to take use valuable court time, which can now be reserved for more serious matters. The idea is to deal with one-off offences where no intent to avoid payment was evident (genuine mistakes if you like).
The best advise here is to pay up, unless the reason for the mistake, was caused by the company and you can reasonably prove this.0
