    Hopefully she will see that you are leaving anyway and see this as an opportunity to let you leave quietly, which will save her a lot of aggrevation.

    If so how ? - eg. did they post a letter (if so when) or have they sent a fax or e-mail ?

    Who will the reference request be addressed to ? (eg. HR or your manager ?).

    At the end of the day you need to keep sight of what you want - you just want a reference that doesn't mention anything negative so that you can leave.

    As tomorrow is "just" an investigation meeting then no disciplinary proceedings have started.

    I would play it by ear tomorrow, be very polite and calm etc. and see how it goes.

    Hi - yes, when she offered me the job she said that she had already put the reference requests in the post today because they assumed I would be accepting the job offer. The reference will be addressed directly to my manager.

    Thanks for all your input. Just hoping it all works out as I really don't want to lose this new job!

    Sorry - forgot to update the post.

    I went to the meeting which lasted all of 10 minutes.

    I put my side across and explained how sorry I was and how that I love my job and would never knowingly breach confidentiality. She didn't know that the nurse had gone around telling everyone, but at the same time wasn't interested and just sat there pulling sarcastic faces.

    I asked how long it would take to sort out and she said in an extremely rude tone of voice 'Well you are on full pay' - She said she would be in touch and that's it.. not heard anything since.

    My partner went and hand posted my resignation last night so she will have got it this morning. Just have to wait and see what happens I guess.

    I am only contracted to give 1 weeks notice, so looks like I'll be spending my last week at home. How do I go about getting all my belongings back if this is the case?
  • I'd go and get them today to be honest; as your notice has been handed in. Or call your boss up and ask when it would be best to get everything.

    Hi guys, more help needed...

    Received a letter today stating that I am to attend a disciplinary hearing on Monday which is the day I start my new job... It also states that if I'm found guilty I'll be dismissed. Which I'm 100% certain that is what they're planning on doing.

    I've been given a copy of the witness statements. They're all conflicting and only one of them (out of three) is close to the truth.

    There's still no proof that I've breached confidentiality.

    Where do I stand now? Should I seek legal advice?

    edit - spoke to ACAS. They have said that they can't dismiss me as I handed in my 1 weeks notice in on Monday, so my last working day for the company is tomorrow.

    Is this right? Should I just ignore it and not turn up? What is the worst they could put on my reference?

    I dunno. I think if your notice went in on Monday 11:02, it takes effect on Tuesday. So your disciplinary is on Monday which is your last day. You are double booked with employers ....

    I would suggest arranging a day late start with the new employer, go into the disciplinary meeting and stall stall stall till going home time and get up and walk out with the process unfinished. That way you are resigned with disciplinary pending rather than dismissed - but you could miss out on being exonerated.
    You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'

    Your last day is tomorrow. If I were you I'd pull a sickie on that last day, and as you're no longer an employee since your notice to leave has taken effect, you can't be disciplined. Do you have record the letter has been posted?

    Please just stick to the basic facts :

    -You attended an investigation meeting (no need for big details)
    -You have resigned to start another job
    -The employer has asked you to attend a disciplinary on a date after your notice period has expired.

    What do you do ?

    What can the employer do in these circumstances ?


    Ps - did your new employer already obtain a reference from your previous employer ?

    It might also be worth asking about this.
