NRAM - Court Hearing today for repossession

Good Morning

After declaring bankruptcy in November and informing NRAM that we wanted to voluntarily surrender the house back to them, we have a court hearing today about repossession.

Personally I am not up to appearing. NRAM have had numerous letters from us stating that we do not wish to object to the order (we couldn't keep it anyhow).

They did keep asking us to sign paperwork which we have refused to do as it could have left us open to costs even after bankruptcy.

My question is this... do we need to turn up? If I don't go will we be liable for any costs etc? The house/secured loan put us in negative equity.

I really do just want to put this awful chapter behind us now and move on.

    If it was me, and I could make it to court without excessive hassle, I think I would. Just to see that it goes through OK and peace of mind.

    It depends on how you feel about it as there is no requirement. I went to court last month for a NRAM repo but that was only to make sure it was done and dusted as I was having problems with the ex. It took all of 5 minutes so not exactly a lot to say as we all agreed.

    If you don't attend (my ex didn't bother) then they just note on the repossession papers that you did not attend.

    Hope it all went through OK for you, and I agree, the stress can be unbearable.

    If it helps - I signed nothing, didn't speak to anyone and didn't attend court.

    It all happened in my absence and all the debt from the house and all the court fees fell into my BR.

  • Thanks guys. In the end I did not attend, I was not up to physically saying goodbye to my lovely house. I had written to NRAm, and told them we had no objections, and I had not signed any paperwork. Just trying to move on with my life now.
