council tax and BR

So im moving to my new rented home in 2 weeks and called council tax who told me that rom 01/04/2013 class c exemption no longer valid and ill be liable for 100% cost each month till NRAM take formal possession... Problem is at £98-£110 a month I can't afford it ... As once we moved n pay new bills our surplus is £65 what was worked out by citizen advice... If I don't pay it what an happen ? I can't file r BR TILL may or June as have to wait for our certificate of failure from IVA ...

Yes, come April there are quite a few changes around council tax.
In april, your right to pay by installments will allow you 2 reminders before the whole amount becomes due, only when that happens can the liability order be sought, and enforcement action follow.
I would suggest that if you file BR in May / June then not enough time would have elapsed from non payment in April to bring any council action.

Changes to the recovery action are not part of the published amendment to the regulations - some local authorities may do it discretionaly but that's up to the local authority.In april, your right to pay by instalments will allow you 2 reminders before the whole amount becomes due, only when that happens can the liability order be sought, and enforcement action follow.
The regulations will allow a maximum of 12 instalments if the request is made in writing to the council and the demand notice is issued before 15 April 2013 (after that the number of instalments will be reduce as the year goes on).I no longer work in Council Tax Recovery but instead work as a specialist Council Tax paralegal assisting landlords and Council Tax payers with council tax disputes and valuation tribunals. My views are my own reading of the law and you should always check with the local authority in question.0
