    The claim started in 2004 the initial assessment "dropped" off system so it became a clerical case Oh joy!

    During the first 3 years there was changes. New job, another child and a period of self employment.So it's very complicated.

    The Csa never kept up with coc and I only received 3 payments September 2007. From case started 2004 to 07?

    Nrp made offer of private agreement This is important. Was the offer made directly to yourself or via CSA in Sept 2007? Anything in writing and we are within 6 years. but never paid as partner lost her job jan 2008 case went back to Csa. The 4 months isn't the issue. But what about months Sept -Dec?

    The problem is they won't consider 2004 - sept 2007 OK they are definitely wrong here:rotfl::T:T as they had apparently started enforcement action as I told them about the private arrangement. Nevertheless enforcement should have continued up to Sept 2007.

    I certainly didn't ask them to stop it I wasn't aware it had begun and was told action would continue to recover arrears.No doubt over the phone and now there is no trace of that phone call?

    Despite all the changes I'm sure enforcement action shouldn't have been delayed for 3 years and my arguement is had it been done after 4 months of non compliance as the guide states it would never have been out of payment for 7 years and there wouldn't be the arrears

    Have you asked for a complete account breakdown from the beginning of your case? If not you want one. This is important. And you must ask for it via your MP -this is very important.

    I would also be asking for everything they hold under the Data Protection.

    I'm not sure of the up to date address but your letter is:

    Please send me the information to which I am entitled to under section 7(1) of the Data Protection Act 1998. I request all computer and clerical records to which I am entitled, and would ask that the notepad sections of the computer files are dated.
    If you need further information from me, or a fee, please let me know as soon as possible.
    If you do not normally handle these requests for your organisation, please pass this letter to your Data Protection Officer or another appropriate official.

    Again your MP could help here. They have to 40 days to respond.

    You need to establish a paper trail from now on of all correspondence and the best way to do this is your MP. This also relieves a bit of pressure off you.

    yes its very been complicated some of the COC's took more than 12 weeks others were nearly completed when anothe coc happens but in saying that months have gone by with no action taken

    Yep 3 payments in 3 years!!

    I suspect he offered the private agreement (this was directly to me) because a liability order was issued in august 2007. this was the first enforcement action taken after 3 years of no payments, i put it in writing can't remember exactly what was said but i'm sure i didn't request for them to stop any enforcement action in fact i made doubly sure they would pick the case straight back up should the private agreement breakdown.

    sept - dec i accept is not their responsibility as i was stupid enough to believe he would pay!

    You agree that they should consider 2004 - 2007 i have stated this in my letter i will make sure the MP also states this

    After the liability order was issued we took up the private agreement and enforcement was only completed in november 2011 after the ICE had looked at the case
    Since november 2011 i have received maintenance and arrears via DOE
    It has taken from then until around november 2012 to get to the point of considering the advance payment. The guy who did the enforcement took advice and told me word for word what to put in my letter i (he was very confident i would be paid the full arrears) initially i had to request a special payment as yet again their mistake caused me not to meet the criteria for an advance payment. My letter was not dealt with as i thought it would be and they rewarded me with £25 for my troubles by the time this has been fought the criteria for advance payment was met so i yet again submitted that, it was rejected reconsidered and rejected again (well they offered me £782 out of a £16,000 + debt) and thats about it.
    I've lost count of the phone calls i've made the calls backs i've been promised wrong information i've been given time and again, even today when i rang the number i've been ringing for the past 4 months to speak to the complaints dept the lady tried fobbing me off and putting me through to bolton, when i politely told her i'd always rung that number she put me on hold for ages then told me his line was engaged and the best she could offer was a 2day call back!so a did a naughty thing here as i also work for a government dept i have access to this guys email so i emailed him and 5 minutes later he called me back!! He wasn't very impressed i'd emailed him though i just apologized lots and blamed the useless helpline operator ;)
    I have copies of all the records it's as big and useful as the encyclopedia brittanica in swaheli i cant make head nor tail of it really. Lots of it is blanked out i expect thats stuff relating to him
