Harrassment from Capquest

Hi guys,
I was wondering if you kind people could help me out with the annoying company named Capquest, who quite frankly all seem to be lacking in the intelligence department. I left my last property in 1999 and have lived in my present home since, unknown to me the next tennents decided to take out a credit card in my name using a false occupation, date of birth and middle name in 2001. I have reported this matter to Capitol one and explained this at least a six times to capquest, who today threatened me with a solicitors letter from H L Legal. I'm seriously angry at this situation and the letters I'm getting from them, I've told them to prove the debt, which they haven't, so what do I do next? Also I haven't reported this matter to the police yet as I've informed capitol one should I do this. I'm currently sitting my final exams and could do without this crap!:mad: :mad: :mad: :mad: :mad:

I'm no legal expert (i'm sure someone will come along soon who can offer better advice), but I would definately contact the police, then write out a letter to them, explaining in simple terms that
1: You do not recognise the debt
2: The name and DOB they have on the application does not match your own (you may want to enquire how the hell they approved it when the details didn't match).
3: You moved out on X date, before the application was made.
4: Asking for a copy of any credit agreement.
5: Send it by recorded delivery with a deadline for a reply and keep copies of everything.
There are some sample letters for getting a copy of a credit agreement (which they have to be able to provide to even start legal proceedings).
By the sounds of it they are largely blowing hot air rather than admitting they have screwed up, any court in the country would most likely throw it out given the mistakes and lack of evidence they seem to have.0 -
I'm in a similar position to original poster. Never owed the money claimed. Capquest have ignored my letters, requests for proof etc and continue to threaten court action. So I sent them a large bill for my time and recompense for harassment. Copied all correspondence in a letter of complaint to my MP.0

Hi mentaljessie, have the same problems with CapQuest. Please refer to my thread "Problems with CapQuest Debt Recovery", posted on the 3rd June 07. Weller711 replied with excellent advice on how to deal with this company, incl. template letter etc. Good luck.0
