Handing in my notice with Paternity leave pre-booked

I really need some advise here, hopefully some of the forum members have high positions in HR.

I have accepted a new job offer and I have the written contact offer in my hand, the start date for the new role is 18th March. My new employer is aware of my paternity leave and gave the start date with the baby due date in mind so they were very reasonable and very considerate.

My baby due date is on the 22nd February and I have 1 weeks Paternity leave booked and 2 weeks annual leave following that.

I am looking to hand in my notice on Monday, my contract states I have to give 4 weeks notice.

Does my current employer have to legally honour my Paternity leave?

What is my baby comes sooner? This would automatically trigger my paternity leave I believe.

Does a company have to honour pre-booked annual leave that ends up in a notice period?

  • A company doesn't have to honour leave booked anyway. If they want to cancel it, then they can - it's usually within the holiday procedure. However, they have to pay you for any accrued statutory leave which you haven't taken.
    If you haven't got it - please don't flaunt it. TIA.

    The leave I am not bothered about I know they will have to pay me. I carried over 5 days from last year so by the end of Feb I would be owed 9.X holidays worth of money.

    My concern is my pre-booked Paternity leave. Its my legal right to have 2 weeks off, but does my employer have to honour this during my notice period?
