Debt Collection Agency - Help!!!

My husband has just had a letter from a Debt collection agency today. He phoned them up thinking that it was probably a case of mistaken identity (as we arent in any debt or had anything like this before). Anyway, they said they had been trying to track him down (we have lived in the same house for almost 9 years now) and that he owes £695 to a credit agency who could provide credit for (amongst other stores) Currys. They had no information on it whatsoever - H only guessing its Currys because the other stores they told him were womens clothing stores. They also said that the last payment made in 1994.

H has absolutely no recollection of this debt and they couldnt give him any information. H mentioned the 6 yr time limit but they said it was past the time limit for them to envoke court proceedings or CCJs but they can still come after him for the money. H ended up just putting the phone down on them.

I am now worried sick whats going to happen or if they are going to be bailiffs knocking at my door.

Can anyone offer any guidance on what to do next?

    He needs to ask them to supply a signed credit agreement. There is a tempelate letter somewhere. I'll try to find it and post a link unless someone else does first.

    As far as I know once the six years is up they can not persue the debt full stop. If your OH has no idea about the debt its likley that its not his anyway. They could just be fishing based on a similar name.

    I wouldn't worry about baliffs they can only come after a court ruling which they have already said they won't be able to get.

    Hi Lisa,
    You have absoulutly nothing to worry about.The debt is 6years old you have made no payment neither have you had any contact,it is statue barred it means no court action can be taken hence no baliffe.If they ring or write tell them so.

    Hi, Please dont worry about bailiffs coming to you. They can only come with a court order. Do not ring them again. Only communicate n writing. That way if they do try and do anything else you have a paper trail to prove you have done everything possible to sort this out. Also keep copies of everything and keep a log of any phone calls.. Which debt collection agency is it. This debt is statute barred. They should not be even chasing you even if it was your debt. Please dont fret about this. If you have a look through some recent posts from Crown, you will find he has a really good letter yu can send to them. Do that and i think you will find you wont hear from them again.     Also check your credit file. Just make sure someone has not stolen your identity.

    Thanks Guys - phew!!!

    H is going to get a copy of his credit file - just to be on the safe side. We are not going to make any contact with the company - and if they write to us again, we are going to send the 'Statute barred' template I found on CAG site.

    Hopefully that will do the trick!
