iS IT LEGAL??

Hi,

Hoping someone can help me out here, came home from work last night and my neighbour from across the road comes over with a message for me. I need to call gary urgently from Wales with a telphone number, curious i phone the number and its a bailiff trying to get hold of my personal details.

Is he allowed to harass me via my neighbours, how embarrassing is that? I think he is obviously a very lazy bailiff....would appreciate your comments, I know they're not allowed to park marked vans outside your home but can they relly call your neighbours???

  • To my knowledge, bailiffs are only allowed to deal with yourself....harassment is illegal and they aren't allowed to force themselves into your home. If they can get in without breaking and entering (an open back door, for example) then that is legal.

    As far as I know, it is actually a breach of the Data Protection Act for a third party to give out your details without your permission.

    Morning and welcome to MSE. Are you sure its a bailiff. This sounds more like the tactic of a debt collector. Did they give the name of the company of bailiffs when you rang them. This sort of thing opens up all sorts. Data protection act. He should not be giving out personal details to your neighbours. Do you have a ccj on anything. . You can also complain to the courts about the bailiff. Did you get a name from him. If he was a bailiff DO NOT LET THEM IN. Can you give us a bit more info hun. Thanks

    This does sound like a Debt Collector rather than an Agent as the Bailiffs would normally have a court order and your details already.

    Nothing would suprise me me though! Make sure you report whatever company it is to the OFT and the Financial ombudsman.

    Sorry, don’t see the outrage. Seems just a cheeky way of trying to get hold of you. Presumably OP isn’t answering the phone to the debt collector/ bailiff, so he called up next door, and asked them to leave you a message to call “Gary” (which could well be his name), and you did.

    Doesn’t sound as if he gave any of your personal information out – e.g. by telling your neighbour that you are in debt. If he did – that is illegal and harassment. But asking them to leave you a message to call them back – heh, I almost admire their creativity!

    BTW, ignoring your creditors (whether they be called Gary or not) isn’t that sensible a way of dealing with debt. Communication, whether direct or via CCS, CAB, is a good first step in dealing with the problem.
