Aktiv kapital.

Hi,

I was just reading through the long Aktiv kapital thread and just came to realise I may of done something extremely foolish and I'm wondering if anyone can help.

Basicly this begins many years ago, I had a bank account with HSBC took out a loan, and then another loan to pay off that loan and free up some cash. First loan was for £1000 then 2nd for £3000.

Anyway made repayments for the first year or so after the loan was taken out,then I lost my job of 6 years, couldn't repay the loan as no income going into account, had to move out of my house, moved back with my parents, got a new job moved on with my life, never heard a peep from HSBC, even tho I was extremely worried, not hearing from them eased this worry.

Fast forward a few years to 2007 I get a threatening letter from Aktiv Kapital saying I owed £9000. At this point I was working again, and back on my feet, so I didn't argue it even tho the sum was way more than I ever borrowed, foolishly thought this must be fees ect :(

Anyhow this so called £9000 debt is now down to about £1500 and I'm paying it off at a rate of £152 a month, just to get rid of it, but after reading the previous Aktiv thread thread I'm a little concerned that I never asked from Proof of my debt or the amount owed and have just given them thousands of pounds that I never actually owed.

So my question is do I have a leg to stand on in terms of finding out what I actually owed, and if so can I get some money back, or at the very least get this £1500 wiped so they don't take that also?

Just in advance if I don't have any recourse I very much appriciate you trying to help me, even if it's just to tell me to suck it up and pay if off. Cheers.

  • At the very least call them and ask!
  • Ask for a statement (showing all transactions, payments and fees). Basically a complete breakdown of the account. Make the request in writing.

    I have a statement from Aktiv which basicly is just a PDF file that has Total £9000 and all my repayments made every month since 2007 and the remaining sum.

    I guess what I'm asking in short is, can after paying this for 6 years can I now ask for proof that the £9000 fee was legit, do they have any obligation to provide this, what would count as proof? and If they can't provide such proof, can I cease all remaining payments without the fear of being taken to court etc?
  • Ask to evidence of assignment (I believe it is called a Notice of Assignment, but could be wrong)
