    I think you have a right to pay off the loan at any time of your choosing, if the Bank refuse then they need to show you under what terms they are refusing.

    Your issues appear to be

    I want to pay off my mortgage.

    I want the all monies charge removed.

    They are two separate issues. Deal with the Bank on that basis. Dont allow them or you to make it a condition of repaying the mortgage that the all monies charge is also cancelled. If it is that is costing you money in the form of ongoing interest.

    If there is still a difference of opinion between you and the Bank regarding the further liability preventing the release of the all monies charge deal with this as a separate matter if necessary using their complaints system

    The emotive language reflects how I felt when I called them initially to ask for the figures. I didn't know the accounts were still active so to speak, thought they had been tied up with the trust deed. However when they said my wife was liable I asked for the total figure, so I could just pay it all. Sadly I don't have an extra 10k over and above the money needed to pay the mortgage off, I do have the 3k that the current account balances were at at the time we entered the trust deed. Had it have still been 3k, I would have cleared it there and then.

    They are investigating that right now, but I would have rather paid the mortgage. They refuse to send a redemption figure that does not include these accounts.

    No, it hasn't even crossed my mind. I simply wanted to clear the mortgage, I had no idea until 3 weeks ago that these accounts were still with the bank. We were under the impression it had all been dealt with YEARS ago. I want to get the mortage paid and the money out of temptations way, If they would accept an offer then that is an option I think. But at the moment they are not letting us move forward as they are investigating the current account situation with regards to the monies added.

    The other option I had considered was just paying the balance on the mortgage meantime and then tidying up the difference between balance and redemption at a later date.
  • Just wanted to update

    Cleared up the issue with the bank today, they are sending a redemption statement in the post and are dropping the charge on the house, because the CAN NOT in fact turn my wife's unsecured debt into a secured debt on MY house. Mortgage will be paid completely within the next couple of weeks.
