Enhanced CRB & Stop and Search Section 60

Hello
A few years ago I was stopped and searched because I was in the 'geographical' region where police had been granted the right to stop and search anybody due to protests going on. I was not involved in the protests but I was in the area and being nosey at the time.
I wasn't told any rights at the time when they asked my details so I gave it to them. The stop and search resulted in nothing and I was given a receipt which I have now lost.
Now I want to study Midwifery i'm concerned the stop and search will show up on an enhanced disclosure. The nature of the protest is not something I wish to be associated with and I am absolutely confident that if it was disclosed I would not get a position at University.
This is really stressing me out as I was NOT involved and it could potentially ruin my dreams of being a midwife
does anyone no if this sort of thing would show up on an enhanced crb? is there anything I can do?
Thanks

If you weren't convicted of anything, it shouldn't show up on an enhanced CRB check.
...and if it did there would be nothing you could do about it. (but it won't)0 -
Hi there,
I have extensive knowledge on the CRB system. Enhanced CRB checks do show up extracts from the police database and depending on how long a "few years" ago is, all that will mentioned on your check is that you were a part of a stop and search.
Don't make this a bigger issue than it actually is. If you were not given a caution, reprimand or warning (the latter two will be depending on your age at the time) and you didn't accept a caution (which is an admission of guilt) the most which will show up will be the stop & search. You can easily explain this one away, just like you did here. It is not a conviction. You can actually ask for a subject access request at your local police station, just go in and ask for a form. It will cost you £10.00 and will list all the information the PNC has on you. It could take up to 40 days. If it doesn't show up, then you have no need to disclose when it comes to your ECRB, this will come back clean.
Best of luck.0 -
I guess it depends what the stop and search was for ie what legislation is was under.
I got 3 Section 60 stop & searches in one day as I live near a massive area that the police designated a S60 zone during protests a few years ago. (it may even be the same as you but it was an area of some 100 square miles)
These had no impact on my CRB check. They are not a caution or conviction and were purely on the basis of my location rather than any suspicion about me personally. If they did have any impact on your CRB check then I think you would have a case against the police.Remember the saying: if it looks too good to be true it almost certainly is.0 -
I've been stopped and searched (wrong place, wrong time and on suspicion of stealing a car - I can't even drive!) then got a job that required a enhanced CRB about 4 months later. I got the certificate back with nothing on it. I don't know if that helps?0

Hi all, thanks for all the advise I feel reassured now! nope it was nothing to do with an individual suspicion on me, I remember the police explained that they were granted the right under section 60 to stop and search anyone within so many metres from the protests.. I was outside a supermarket at the time! I do admit I was being nosey wanted to know what was going on though. But they searched me, checked my handbag, give me a receipt of the search and walked away.
I'm glad its not something that has shown up on CRB's as I later found out the nature of the group protesting and its definitely not a group I want to be associated with, ever!
Thanks

I have previously done a subject access, and one reprimand did come up, when I was a silly teenager I got into a school girl fight! Sad that is on there as I was told at the time that it would be removed after 2.5 years and was just a 'slap on the wrist' so to speak.
I did have another fight when I was stupidly young, around 12. I was attacked and acted in self-defence and the girls mother got the police involved. I didn't admit guilt as I was bullied from this girl all through primary school and she attacked me! this didn't show up on the subject access, but could this be because it was 'spent' or just an 'accusation'.. I'm pretty sure I didnt accept any caution. Ive looked into a reprimand and it appears to be what is given in the event of a minors 'first offence' so I can only assume that the fight I had at 12 did not result in anything. However, would such a thing show up on an enhanced CRB?
Hope that makes sense, and oh how I will ensure my children do not get into silly school fights since it can have such an impact on their future!

Luckily being nosey isn't illegalI'd be amazed if a stop and search that resulted in no further action and only happened because of a nearby protest could affect your career progression. I think the absolute worse that could happen here is you having to explain the situation, but I highly doubt anything will show on the CRB. Good luck with the course!
