Advice re leaving the country and BR

Hi,

I have posted on the other board and have been adviced that you may be able to help me over here!

My brother is talking of going abroad, he is in a complete mess with his debts and is really not happy here. I think he wants to just go and leave the debts behind.

My worry is what sort of trouble this could get him into, I know that after 6 years they can be written off but I am worried he will get caught up with when he comes back to visit the UK and be in more of a mess.

I have spoken ro him about maybe going bankrupt and really hoping for some advice to convince him of this (if you guys agree that that would be a better option!!).
Also is it possible that the companies will just go ahead and request the bankruptcy if they do not receive payment from him.

Any ideas of what I can advise him would be much appreciated!!

    Ok, first off, a bit more info would be appreciated if you can supply it. How much is he in debt? What are his incomings and outgoings? What debts are they? Credit cards, loans, mortgage?

    He would do well to seek professional free advice from one of the independent debt advice places:

    Running away is akin to burying his head in the sand, not a good idea and unlikely to achieve anything.

    As for the creditors applying for BR, well, all depends on what type of debts he has and for how much but for general credit card stuff, it's highly unlikely they would spend out more money making him BR, it's far easier to simply chase him for it. And he wouldn't want a creditor making him BR as there is a bigger stigma attatched to that than self-petitioning, for some strange reason.

    The best advice you could give your brother would be to visit one of the debt charities, CCCS, CAB, National Debt Line; their advice is free and confidential and they have trained advisors that will be able to give professional advice and explain all the options available to him.

    I don't think it's a good idea to "run away" from his problems because that may well come back to haunt him if he ever wants to return to the country. It would be much better to deal with them first and then make his plans accordingly.

    If one of the debt charities does recommend bankruptcy then your brother will get all the support and advice he needs on this forum.
