Being made to go sick when fit and able to work

I was hoping that some one could point me to the right web page for this.

One of my best friends has epilepsy and he had an epileptic fit (Peiti Mal Seizure) at work on Thursday, (hes had epilepsy since about 12 and copes fine with everything (drugs etc), he hadn't told his work about his disability due to previous work discrimination (long story for another post)) unfortunately he hit his head on the bathroom wall which ended the day in A&E getting 5 stitches.

He went into work on Friday and at the end of the day they told him he needed a letter from the docs saying he was fit and well to work, which he went and got this morning. He went in this afternoon and management said that he wasn't going to get paid for today and they are putting him down as sick, yet he is fit and able and willing to do his job. He has a feeling that he is getting fired tomorrow as well just because he didn't disclose his disablity to them (If and when, i'll be back for more advice :rolleyes: ).


Just been told to add that his work dont have a sick pay scheme, the staff have to claim Statutory Sick Pay off the DWP :mad:

    I think they are trying to cover themselves if he has a fit and hurts himself while on their premises and time

    The company are obliged to pay SSP providing your friend has earnt the LEL to qualify!!

    If they are telling him that its their policy to cliam via the DWP then they are either stupid or pulling a fast one!!

  • SSP is usually paid from the third day from illness/sickness.

    First 3 days are called 'waiting days'.

    Could his epilepsy possibly affect his safety or that of others at work? machinery, equipment etc.

    I think he might want to contact ACAS: I don't know whether you would always be advised to disclose a health problem like that because of H&S concerns, but they might.
