Orange won't pay me back for overcharging on my bills

Hi. I was wondering if somebody would be able to help me.

I was previously with Orange as my mobile network provider and they overcharged me, starting last May for 4 months. The charges were around £150 and when I complained to Orange they refused to repay the money. I then went through the Ombudsman service but they could not act on telecommunications so I went to Communications and Internet Services Adjudication Scheme (CISAS) who contacted Orange on my behalf and finally on the 17th November 2012 I received an email from CISAS saying Orange had agreed to pay me the money back and had until 17th December to do so.

The 17th December passed and so I contacted CISAS again letting them know that Orange had not sent me the cheque and they got in touch with them. Orange then replied saying they changed their ‘cheque printer’ and so a back log was created.

It is now 24th January, 68 days since they said they would pay me the money and 38 days since the end of deadline that they were set to pay me. CISAS say they can’t do anything and its obvious Orange are not bothered.

I do not know what to do in this situation? If this was me owing a company money then my credit rating would go down and I would have a letter sent round informing me that if I did not pay then my property would be repossessed until said debt was repaid.

How come Orange can get away with it and not be penalised when I am left powerless? What do I do to get my money back?

Any help would be much appreciated.

    If you've got proof that they said they would pay, and they havent, can you not take them to small claims court? Whats the point in CISAS if they can't do anything?
  • Well at first CISAS said if they don't pay by the given date (17th December) then they would be able to take further action but I think that because they made the excuse of 'changing their cheque printer' they can get away with it.

    It's a total joke, it doesn't take more than an hour to hook up a new printer onto a network and a business of this size would surely keep the old one running whilst a new one was installed.

    I'm not even with them anymore as this is only 1 in about 20 separate issues I have had with them but they still seem to be able to aggravate me...

  • Also with the small claims court will I not have to pay to do that?
