How do I push the CSA?

also, have you asked your ex to show you his last 3 payslips... if he wont, then...
but if he does, whats the issue... - remember its going to cost him money to get to work too...
also, if he is working 9-5, your saying hes on min wage - consider that most employees have an unpaid lunch break (1 hr)...
and nmw jobs are very common... (im taking up a trainee manager position soon which is at nmw - experience and job satisfaction is often worth more than the wage)
He wouldn't show me his payslips in a million years. In fact, as discovered on the phone to the CSA yesterday, he hasn't even shown them his payslips. All they asked for was verbal confirmation of his income from his employer.
If he was on national minimum wage, working a 37.5 hour week, the CSA calculator says he should be paying £35pw - or £151 per month. He pays £130. I know it's not a massive difference, but it's the principle of the fact he's always said to me "I know exactly how much I should pay and it's this..."
What do you mean, it's going to cost him money to get to work? Why is that any concern of mine?

well think of it this way.
he has to pay rent on his house, so he can stay warm. buy food to live on... or put fuel in his car to get to work... which doesnt get paid first?
if he doesnt go to work = no wages.
no wages = no csa.
see how it is a concern of yours...
and... 35 hrs a week...
35x6.19 = 216.65...
how much tax and ni is that? - its about 20%?
so 216.65 becomes (minus 43.33?) 173.32 = reduced rate...
even if its only 20 quid of tax it goes to reduced rate...
reduced rate is a fiver for the first 100 of income, then 25% of income for the remaining (one child)...
so lets say his income is 195, he pays less than 30 a week.
obviously his income is an average of his net income...
this takes into account tax, ni contribs and pension contribs.
does he have more kids?
does he have contact costs?
do you know for sure how many hours a week he works (paid)? - not how many hours a week he is at work... I used to go to work for 5 hours a week to do training which was unpaid (education course which company paid for - but it appeared on my rota still.)
it seems to me that your making assumptions... (not being nasty either) but have you asked to see his pay slips...
you said he wouldnt show you, did he say this? did you ask? or you just believe he wont show...
and for the cost of a stamp,and envelope i dont see why you will only "think" about requesting your file... surely you should do it... a quid wont break the bank will it?0 -
The reason I have contacted the CSA is so that they can find out about his income and so that they can do the calculations. I shouldn't have to.
The assumptions I am making about his character and his attitude to this are based on an eight year relationship and seven years of being divorced from him, so it's not just a stab in the dark.
I presume that within their calculation, the CSA will leave him enough money to go to work (tbh, I think he cycles anyway). I only want him to give the children the minimum that the CSA require of him.
I don't know what you mean by 'contact costs', but again, I presume that these are all part of the CSA calculation (ie. they reduce the liability in line with the amount of nights the children spend with him)??0 -

Look at it this way. You have housing costs etc too!
The CSA can contact his employer direct and issue a DEO accordingly if necessary. I keep telling you to contact your MP as it's quicker as the CSA get a kick up the ar*se to do their job!
You don't need to justify your reasons for involving the CSA!0 -

He'll be left with 80% of his takehome pay (assuming that you have two kids), which is reasonable enough I feel.0 -

I've been in this 'chasing game' for years now. Definately the best thing I did was write to my MP when the CSA were treating me like they are treating you. I agree with Sensmaya who has also been in the 'game' for years.
Well done, but don't just leave it at getting the list of surgeries, I would write immediately to him outlining the CSA's failure to repond within an acceptable time frame to your January 2012 request for reassessment.

Don't forget that for every 52 nights of the year he has a child his payments will be reduced by 1/7th...
If you want your file, it is called a Subject Access Request, and while you may get it for nothing, you are in fact supposed to pay the £10, and it is far better to pay it than to not, as they will just delay things if they want by not including it... Whenever i have paid mine it was credited to the account as a payment. So if you paid it would probably be credited back to you anyway, but the point is it just makes things easier to pay by cheque...0 -

Thank you Kevin. I've been using this calculator, which takes nights per year into account. To be honest, it's got to the point where, even if the csa come back and say he's paying too much, I just want an accurate figure. It's my way of saying "you don't make all the rules any more; not everything is up to you" if you see what I mean? It was quite an oppressive relationship and it's taken a long time to build my confidence to this point.

Even if it gets sorted before he replies, he should be aware of how shoddy this has been. Apparently he's currently the minister in the cabinet office responsible for coordinating government policy.
