Need to move back into house with buy to let mortgage

Hello,

Seperated from husband and need to move back into the rented property we jointly own.
Will this be ok? or breaking terms of mortgage?

I am not in a position to take on mortgage on my own either.

What options do I have especially when divorcing?

He has agreed to transfer 100% on deeds but really want him off the mortgage.

Thanks in advance

If you move back in then it stops being a buy to let, need to check to see if there are any redemption charges.

You would then need a residential mortgage, so subject to normal criteria of income, ltv, deposit/ equity.

If you can service the mortgage anyway then you might be able to just not tell the, not sure of the legality of this but you are normally penalised for a buy to let by paying a premium on rate so may be ok.

You can live in a property with a BTL mortgage, should you choose to do so, during the life of the mortgage.

The problem is taking out a BTL mortgage when you have no intention of letting the property, for example, to get a back-door self-cert facility.
