overtime pay for monthly paid workers

I work for a small company that pays me weekly (min 40hrs) but overtime is worked out on a monthly basis i.e anything over 160hrs a month is overtime.

normally i do over 40 hrs each week, occasionaly i have no work to do on certain days (this monday is one of those days), when this happens it cancels out some of my overtime at the end of the month. next week i should work about 46 hrs, but because of my 'day off' i will work about 40.

This means at the end of the month the 'day off' has cost me about 4hrs pay if i asume i would have worked for 8hrs on the monday and that overtime os paid at time and a half.

Its difficult for me to explain the workings out, hope you understand.

My question is: If you are a monthly paid worker do you get overtime paid on a weekly basis or is it worked out on hours done over the month ?

    I get paid monthly and my overtime is worked based on the no of hours i work over the month, which may be different each week dependant on the rota and how my days off fall

    What would happen if you had worked 8 hrs overtime in the first 3 weeks and then on the fourth week your employers gave you the 'day off' as there wasnt any work for you to do.

    would you still get the 8hrs overtime ?

    Hi

    That seems a touch rough, in your contract are there days and hours you should work between? i.e. contracted to work 9 till 5 between Monday and Friday etc? if so anything outside of these hours is overtime, irrespective of whether days are taken off. Your employer is telling you to not work on a day when you are contracted to do so, so it should be their loss and your gain. That is my opinion and the way it works in my case.

    Thanks for the reply 'save a lot', it does seem that im loosing out financialy and i think i need to speak to my employer about this.

    We are paid to deliver a project on a particular date ... if we deliver early then we can effectively do what we like .. if we are running late then it is not uncommon for us to be working 14-20 hour days for a couple of weeks culminating in 24-36 hours solid ... and we never get paid over time

    That is the dilema I face, I am up for a promotion and this would mean a jump to the next band that does not pay overtime.

    Surely your arrangement amounts to TOIL (Time Off in Lieu). I would have thought that this was quite common and an acceptable arrangement. I wouldn't do anything to jeopardise a promotion, even if you lose your overtime entitlement!
