Paid CCJ within calender month and court not removing it!!

Dear All

Please help!!

I recieved a CCJ from the water board (SEven Trent) on 14th Dec 2012, I paid it in full on 7th January 2013. Bith the court and Seven trent reassured me that the CCJ would be removed as it was within the calender month.

I have proof on my bank statements as to it being paid on 7th Jan, but seven trent have written to the court with no proof it was paid on 7th Jan and the court won't remove.

What do I do? I am trying to get my credit fie back on track as I am desperate to start applying for mortgages soon !!!

  • You could pay your debts on time maybe to prevent it going to a CCJ. It doesn't matter if it was satisfied within a month to a mortgage lender your going to have to go to a sub prime lender anyway so don't worry and just speak to a broker.
  • its should be removed if you pay within a month thats the law!! Even the court says that, removed with no trace of it being there so I shouldn't have to go to a sub prime lender thanks!

    I just got some useful advice fron this forum because I found I had a CCJ registered on Equifax account that had been paid within the 30 days, also from a water authority.
    Because you paid within the time it should not appear on the registry trust. I had to pay £4 to get a copy which showed I didn't have any judgements registered and then I sent a copy to Equifax, they have now removed the CCJ .
    The problem I found is that once they get paid, the water authority don't bother to tell the court that it has been satisfied.
    Fortunately I did write to the court at the time and sent a copy of my digital receipt, which was then date stamped by the court and sent back to me.
    You need to get this tidied up before any mortgage application but it may take a few phone calls and emails to achieve it.

  • OP, Have you chased up the 7 Trent to make sure that they have told the Court that the debt was paid before the end of one calendar month. If they haven't, and it is their error then I would push them to pay any fees due. It is their responsibility to tell the Court that the ccj is satisfied.
    Also, I would keep an eye on your credit files for a few months to make sure it does not appear (as mine did on Equifax).
    Bottom line is that no CCJ should be registered against you as you paid within the calender month.

    Thank you for you helpfull reply dizzy!
    My husband is currently awaiting a letter from the water authority showing payment date. He rang the court and they said that the water authority have informed them but told them I paid after the calender month.

    I will await the arrival of this letter from them and send to court so it will hopefully be sorted. If you pay it really annoys me how you have to fight tooth and nail to get it it removed when it is a normal practice to remove it,

    Not all debts which go to court are about late payment. Some are disputes about whether there is a debt at all.

    In such cases it is entirely appropriate for someone to let the dispute go to court and let the court decide on whether the claim is upheld. If someone loses such a case and pays up within the time allowed why should their credit be affected? If a CCJ automatically damages credit ratings, then it would be dead easy for big organisations such as Severn Trent to bully people into paying up on disputed debts for fear of losing credit.

    Who knows, maybe you will need to dispute a debt and fight it in court one day? Perhaps if your uncharitable attitude gains traction, you will have to give in and not fight it in court for fear of losing your credit rating?
    You might as well ask the Wizard of Oz to give you a big number as pay a Credit Referencing Agency for a so-called 'credit-score'
