Hi just a quick question. Does anybody know why it is ESA policy for full time students that are claiming DLA are automatically entitled to ESA but for every body else this isn't the case?
I found this information on the disability rights site and was rather confused by it.

I don't know - you'd need to look back to the consultation papers prior to the Regs being introduced. Maybe something your MP could get an answer on?0

Can you point us to the information that says that anyone on DLA is automatically entitled to ESA? I'd love to see this considering that I am on the highest rates of DLA yet stand to be chucked into the JSA queue!0

I never said anyone I said students on DLA, it is also posted on the direct gov website under the eligibility section. My question was exactly that why does that make students eligible but doesn't come into account for anybody else. The one catch is that the claiming student can only be in the income-related group and not the contribution based.0 -

It's true as I'm currently trying to go through this process and a friend has just been through it.
I too think it's very unfair and couldn't believe it was actually true since there are many more people with more complex needs then mine.
Try talking to MP or do a Freedom of Information Act 2000 request to DWPTime to change for the better!
