    Thankyou for this dunstonh, They are supposed to be paying me the difference of what I would have payed, had I had a capital repayment from the start, with interest over the last 9 years, up until the day they pay me. Looks like I'm gonna get even less now!! I'm doubting that I will get very much to be honest, wouldn't surprise me if it was just about £100, with 20% going to ECA leaving me with a lovely jubley amount of £80!!

  • Another update!!
    Still no idea of how much we are supposed to be getting. Sent the acceptance forms back 9th september, we are nearly in feb, so thats 5 months of waiting for our money to be calculated and sent to us. Can't believe its taken so so long after the ombudsman has said for them to pay us. Especially when Im reading about all these lucky people who have had compensation payed up after a month or 2, mine has been ongoing since july 2004.
    People said that "Winterthur" were not very forthcoming with paying up and they weren't kidding!! :(

  • I started my claims process for mis-selling back in August 2004 and I'm still waiting to hear if i'll get anything. I did have to go through the FSCS as my financial service advisor had ceased trading, they had the claim for 14 months before passing it on to Higham Group.

    Hope you don't end up having to wait as long as I have.
  • Winterthur are above averagely poor in paying. I won't defend eca any more than I would defend the life company, but Winterthur know that realistically they can drag their heels and by the time you report them to the ombudsman again they will move you up the queue and within a few days you will get paid.

    Yes, its annoying to have them take time on your offer, but remember that the situation will be redressed within their final offer and if you are not happy you can have the FOS review the offer made.

    Hi cjb2611, THanks for replying. I actually started the claims procedure july 2004, so it looks as though you are in the same boat as me, the waiting and becoming more and more increasingly naffed off as time goes by boat!!
    I'm not actually sure whether to ring winterthur up myself rather than rely on ECA to do it for me, see if I can get anywhere furthur with this. Or maybe return back to the ombudsman, not sure yet but another phone call to ECA is brewing.
    By the way, if there are any bods who work for ECA, reading this "Get a move on, I'm paying you 20% for you to do absolutely sweet FA. Sodding waste of time"!! :mad:

    Hi defender, thanks for replying. Do you think it would be best for me to contact the ombudsman or winterthur to try and shove a bomb up their bum, or get onto ECA, and try and make them do it?? Every time I call ECA, they just tell me "we keep ringing and they say its on its way". No bleedin good to me, when I am wanting and in desperate need for my £'s!! :confused:

  • If ECA are not moving it go back to the ombudsman and voice your concerns, a call from them will carry more weight than eca.

    If you think that eca have not lived up to their billing and provided little or no service get winterthur to pay you and argue about their bill

    Many Thanks for replying back defender, I shall ring eca on mon, see what they have to say, probably be the same as the last 5 months, and then I shall get in touch with the ombudsman.
    Also, I think its a good idea to argue the bill, as its an awful lot of money to pay them for doing abolutely sod all, I thought they would have fought for me alot harder than they have. Its always apears to be young kids that answer the phone and they sound as though they haven't got a clue, I'm just getting fobbed off. How do I ask winterthur to pay me instead of eca?? Do I ring them, or put it in writing?? Doesn't sound as though eca want paying to be honest. you would think they would want me off their backs, and would want their cut of the money, and would therefore attempt to speed things up. Wish I knew you could complain without the robbing claims company, before starting the process!

  • If memory serves, Winterthur should pay you direct anyway. When the offer comes out you have to sign it and detail where you want the money to go, so ask for a cheque in your name or a direct transfer to your account or mortgage. When you get the bill from eca write back and politely offer them what you think the service was worth based on your experiences. Remember, you signed up for this of your own free will and I assume the contract is tight enough to take you to court if required but it is a lot of hassle, so they may settle on a compromise figure.
  • Thankyou for all your advice defender,
    I have tried to telephone ECA and they are not answering, so I have left a message on their answer phone, asking the status of my claim, and that I am contacting the ombudsman, and should they wish to speak to me, to call me.

    I have then gone onto send an email, to the lady who said winterthur should pay up, explaining whats not happening, she replied immediately, saying she has sent winterthur an email, telling them to send us the offer within 14 days. If we do not hear by 14 feb, we are to contact her again.
    Hopefully this will give them a shove, fingers crossed, we will finally get somewhere.
