Moorcroft Debt Recovery Limited

Options
Hi All, Sorry, this is a long one!

I've been a member for a while but haven't posted for a long time now.

I received a letter on Saturday from Moorcroft Debt Recovery Limited regarding an outstanding debt with Arrow Global Guernsey Limited for £2204.88. I had never heard of either of these companies until I got this letter.

The letter says:

"We have been asked by ARROW GLOBAL GUERNSEY LIMITED to take over the administration and collection of your account.

We understand that you may have been making payments via a third party debt management company. If this is the case please call them and ask that they make contact with ourselves (details of how to contact us are contained on the reverse of this letter). If however you have been making payments directly please contact our offices so that we can discuss a repayment plan that you are able to afford and maintain.

We would emphasize that it is extremely important that we hear from you or your representative in the next seven days as we do not wish to take any unnecessary further action"

On Sunday I searched the forum here for advice and sent an email to Moorcroft which was simply the National Debtline letter regarding an unacknowledged debt. I added nothing to it other than the relevant details and gave it the subject heading 'unacknowledged Debt Query'.

Tonight (Tuesday) at 8pm, Michelle Smith from Moorcroft rang me. I was taken by surprise and told her my address (as it was on the letter they'd sent me). She then said they had my address as XXXX Avenue and asked if I could confirm this address. I said No and she asked why not... I replied that I had never lived at any address even resembling that one. She then apologised and said she had the incorrect account on her screen!

She then asked me to confirm my date of birth. Having read much advice on here, I said I would prefer not to as I would rather keep all communication between us in writing. She then said, well I'll tell you the year you were born and you can confirm the month. I again refused and said again that I would prefer that they communicate in writing. She said 'We've already done that, so if you keep just telling me no, we'll have to take it to the next stage, to which I replied 'that's fine'.

She then said that I have an outstanding debt with Arrow Global, to which I replied that I have never had any dealings with Arrow Global. Then she said 'well have you ever had a credit card with MBNA?' (I do, but not for that amount - and I have been in regular contact with them and paying £1.00 per month by mutual agreement for a while now, with no problems). I said I was not prepared to answer that either and repeated again that I would prefer them to communicate with me in writing.

She then asked me to pay the full balance on a credit or debit card, to which I said 'No'... She replied 'So you're unwilling to pay that amount then?' I said 'No, I'm unable to'. She then said they would accept half the balance now and installments for the rest, to which I also said 'No'. So we got a repeat of the you're unwilling / no I'm unable to pay conversation...

Then I told her AGAIN that I want all communication to be in writing! She asked if I'm employed (and I got caught again by surprise and said no, I'm self-employed). She then said, 'So you're unwilling to confirm any information or pay anything towards your debt.'... I replied that I have no knowledge of any debt to Arrow Global and I would like them to communicate with me in writing.

I am a bit annoyed with myself, as I didn't ask if they had received my email. (I have had no reply to that as yet). Should I send them a follow-up email re-iterating that I want them to communicate with me only in writing?

If you have managed to get this far, thank you for being so patient! :o

Hopefully someone will be able to help. Or at least confirm that I've done the right thing so far...

Next time they ring simply terminate the call. If you want to deal with something in writing don't worry about being polite simply click the hang up button!
Paid off the last of my unsecured debts in 2016. Then saved up and bought a property. Current aim is to pay off my mortgage as early as possible. Currently over paying every month. Mortgage due to be paid off in 2036 hoping to get it paid off much earlier. Set up my own bespoke spreadsheet to manage my money.
  • Thank you for your replies. I have sent another email stating that I will only communicate with them in writing and will not discuss anything on the phone. If they phone me again, I will certainly just hang up and send the harassment letter.

    Thank you again

  • Just to add that I haven't received anything from MBNA about the debt being passed on to anyone else and I've never had any letters or phone calls from Arrow Global.

I'm carrying on paying the £1.00 per month to MBNA until they tell me to do otherwise.

  • MBNA do sell on bad debts on a regular basis ( few cases on here, plus you can google it as well) I would recommend you send letters by registered post and not e-mail, as e-mail has no proof of receipt

    Hello there,

You may have already come across it, but in case you haven't here is our harassment fact sheet:
    http://www.nationaldebtline.co.uk/england_wales/factsheet.php?page=03_harassment

If a debt is sold on, you *should* always receive a letter informing you of the assignment prior to anyone trying to collect money. You're right to request correspondance in writing only, that way you'll be able to keep a copy of what has been discussed.

Really hope that it all gets sorted!

    Best wishes,

    David @ NDL.

  • Thank you Owen and David!

I will print out my letters including the harassment letter) and send them by recorded delivery tomorrow.

I had another call from Moorcroft at 8.00 tonight (same time as last night). Initially I could hear 'call centre background noise' but then I got a recorded message asking me to call them. I hung up.

Does 8pm count as an unreasonable time to call?
