Can I apply for early discharge?

Hi all,

I went bankrupt end of August so I've got about 8 months left. I've read about early discharge and I'm wondering is it something I can apply for? Should I email my OR and ask?

    Nope. If you are in a normal bankruptcy where you would be automatically be discharged after 12 months, you cannot apply yourself for early discharge.

    So I just have to wait it out. How common are early discharges currently? I think my bankruptcy was a pretty straight forward one, unsecured debt, no assets, well I paid to keep my car.

    Hi, much depends on the OR's office workload.

    Applying to the Court for ED is a time-consuming matter, and lacks 'importance' in the greater scheme of things, hence the 'rarity' mentioned by rossireps.

    It is, a 'nice-to-have', 'tis all....and AD comes around with little effort or fanfare.
    No, I don't think all other drivers are idiots......but some are determined to change my mind.......

    I got mine after 8 months but it's dependent on a number of things... how straightforward your case is...how quickly you provided the OR with all the info they needed...how much chance the OR has of making any "profit" from your case...basically are they trying to clear a backlog to concentrate on more complex/dividend high cases...is your file taking up space on someone's desk...
    In truth I'm not sure there's any particular policy...it's pot luck. If they have the spare manpower you've got a chance if the above provisos apply but it does seem that EDs are less frequent than they used to be, because manpower in the OR's offices has been steadily cut over the last few years.
    You could ask, I suppose, but I don't know whether they take kindly to requests. I wasn't bothered one way or another so I didn't push...it just came out of the blue.
