Looking for some advice on behalf of my parents. If anyone can help can they please e mail me and I will reply with my query. Bit long to explain on here. In short my mum is locked into the trust deed whilst my dad came out of it about three years ago. Original debt was my dads but both liable due to being married.

If a debt is in your dad's name only, then your mum is not liable for it just because they are married.
She would be liable for joint debts, but not his debts.
I know you asked people to reply by email, but I prefer to give comments/advice on here. That way, if there are errors, or things that I've missed, other people can pick up on that and correct it. So you get a good range of advice.
It wouldn't take you any longer to type out the whole story on here rather than in an email. You just have to watch how much personal detail you're giving - and I guess you would do that in an email anyway, since you don't know who you're talking to.0 -
My parents had a business but for one reason or another they ended up having to sign a trust deed. My mum only very occasionally worked in the business but I think everything was in joint names. Anyway they signed the trust deed and lost their house, cars, etc. The deed ran its course and after the term they applied to finish it. My dad was allowed to leave but they told my mum no. This was due to the fact my gran has left her house to her daughter and son in a 50/50 split. My gran is still alive and living in the house buts its in my mums and uncles names. They trust deed wants my mums share out of the house before they will allow her to leave it. My dad has been out of the trust deed for about 4 years now. The situation is causing my mum and espically my gran heartache. My uncle will do whatever he needs to do to protect my mum as my parents don't have the money to buy out their share of the house. Any help or advice would be greatly appreciated.0
