Two choices, either your mum talks to the person or she takes them to court over it but that might be pointless if the other party just can not pay. Can the other party pay or not ? did they stop the payments because they couldnt afford too ?

she has talked to him but he stands firm that he cannot pay, dispite making it very plain that he has extra cash that he could be giving to her for repayments. i think even if he paid half or a quater it would be better than nothing to her.
are you saying she could take him to court over it?
her biggest worry is the ccj and trashed credit score. if this is inevitable its probably better to get it over with sooner rather than later?on the road to recovery..:o0 -
She signed the dotted line and since said person can't repay she will have to, she can bicker against Amigo all she likes but the reality is she signed a legally binding document to make payments to the Amigo should said person not want to/be able to/ can't be found etc etc, they will want their money and it will have to be paid somehow, she hasn't a foot to stand on.

She didnt actually sign anything, it was all done over the phone. I don't really know how it works in that instance..on the road to recovery..:o0 -
There is no way she can guarantee a loan without singing something even if its an e-signature online by typing her name they have to had made sure she fulfils certain criteria.

It's heartbreaking she was only trying to help him out but hes not likely to wise up so this is why I've come here for some advice, notice I don't want any advice for him!

All of the advice that I was going to post has already been covered here. But I do hope that everything gets sorted, Katy, especially for the mum. It's bad enough being stitched-up by someone financially, but when the culprit is your own child, it's especially wretched.
I don't always see eye-to-eye with my mum, but I could never do something like this to her; it's evil.

Im not up to speed on how it works really, depends if she wants the hassle of it all, might be just better of paying them nd leave it at that and not get involved with the other party again or even amigo loans at that.0 -
I can only re-iterate what has been said. Basically, when you're a guarantor; you're signing for a loan and agreeing to pay it back, and someone else gets the money. I would literally not be a guarantor for ANYONE on the face of the planet; nor would I ask anyone to do it for me. Unfortunately, this is your mother's debt, and she has to meet the payments now. Why anyone would want to be a guarantor for anyone just baffles me.0

Yet another example of why you should never be a guarantor for a loan. If you are a guarantor then the loan is yours. It is a con artist's charter.
If you can get someone to be mug enough to guarantee you, you can walk away from your responsibility whenever you want.
It really is sad to think of how many people do not have the faintest idea of what being a guarantor actually means.I can afford anything that I want.
