help for daughter

Options
My daughter has just informed me she is in debt to the tune of £30,000 and has been served with papers for a CCJ. The bank that has served her the CCJ will not reply to any of her letters or emails and will not give her details of how to make payment on the account, does anyone know what if anything we can do stop the CCJ, or how to deal with the bank as we think they must be breaking FSA/Banking rules by ignoring her.
Sorry for throwing in a biggie as a newbie but all help would be greatly appreciated.

THey're not breaking the banking rules by ignoring her. If she's in debt and not made payments, they're perfectly entitled to seek a CCJ. She's had more than enough chances to make payments as CCJs aren't the first action taken and she's chosen to ignore them so the bank has drawn a line under it.

If she's already got the CCJ, there's nothing you can do.
  • How can they expect her to make monthly payment when they won't reply to her letters and emails asking for bank details??

Banks will never work via email - its not secure.

Have the letters been sent recored delivery? Phones can be difficult but if she phones them she will know she has contacted someone.

As far as i am aware once it has gone to ccj the court has to be paid. Your daughter should have recieved quite a few letter asking for this to be sorted. I may be wrong but from what i have seen with my cousin with her ccj's she has always had to pay to the courts. Not the company as it as been passed on out of their hands so to speak.
You can touch the dust but please don't write in it !

Would you like to speak to the man in charge, or the woman who knows whats happening?

    Welcome to MSE.

If your daughter has 'genuinely' (and I'm not saying she hasn't but you know how kids are when they are trying to dig themselves out of a hole!) requested information on how to pay back the debt then has she got copies of the requests?

Has she been putting money aside to make a lump sum payment ? (this will practically demonstrate her intention to repay the debt)

If she has then I would submit this as evidence of her intention to repay the debt when she enters a defence......I'm not sure if it would help but I might be tempted to submit evidence of her available income as well along with a proposal for the repayment of the debt....at least this may give her a 'stay of execution'.

She does have 30 days to pay the CCJ from the issue date.

If it is paid, the judgement will be set aside.
