Cabot, almost finished paying them off but...

Options
Hi,

I've just received my credit report from Equifax and it had an entry on it from "Kings Hill (NO. 1) Ltd." I just found out that they are Cabot and I've been paying them over the last year and my final payment is next month. They have also added 1 entry in the monthly status, which is a default.

Now, this was bought from Monument (credit card). Now I've just found 2 letters from them, 1 stating the balance is £591.33 and the other stating that the balance was £1021.33! Nearly double what I originally owed.

Now my question is, should I have paid that? Was I legally obliged to pay that? Can I get these (obvious) charges back?

By paying this and setting up a payment plan over the phone, have I
accepted liability and no longer have a leg to stand on?

Thanks,
Luke. :A

P.S: I've also posted this in the Cabot forum.

Yup, that is. The thing is, I've only £75.33 left to pay. Am I still entitled to get this huge markup back? Can I also force them to remove the default on the original debt? they were after me for ages and I kept ringing them and trying to sort it out, which never happened, then it just got to me and I just said to myself, ok, lets sort it.

Now, I'm thinking that if I can get this back, there are others I can do the same with also.

Another brilliant example of the blind leading the blind - and to make matters worse he got thanked for it, probably because it was what the OP wanted to hear !!

I am almost certainly more familiar with these contracts than you are and know that each one can differ; so how can you draw a conclusion like this ''let me explain if they have brought the debt or not they cannot add any more charges to your account that is a fact and dont't let anyone tell you any different.'' when you have not seen the original debt sale contract or the original loan agreement which will almost certainly include a clause allowing further charges and interest ?

To the OP - you really need to check your documentation thoroughly and then request some form of statement outlining all charges and interest added to your account and why.

On my Equifax statement, they are listed as Kings Hill (No.1) for a credit card, Cabot have been in contact with me and I have been paying them. They did charge extra. Are they allowed to do this or not (even if there is a clause stating that they can add further charges, etc.)?

I will be going through all my documentation and placing them in separate folders so that I have all of it in 1 place. This way I can track it much more easily.

    Thanks,
    Luke.

I have received a letter out of the blue from cabot saying they have bought my bank of scotland account and I need to arrange to pay them, blah blah, blah. I have never had an account with bank of scotland or any of their affiliates, and have done a thorough check through halifax and royal bank and there is no account owing anything(as I knew).

phoned back to cabot who said send copy of driving license and passport to prove who I am.

anyone had dealing with these people, are they a genuine company?

You are probably better off posting this on a new thread.

Debt collection companies buy debts and very often they are just trying to trace the possible debtor. They often either accuse the wrong person because you might have a similar name or the debt belongs to someone else living previously at your address.

They have requested the driving licence, etc so they can compare signatures, dob, etc.
:D Thanks to MSE, I am mortgage free!:D
