How can I get off my ex-husband's mortgage?

I split from my husband im June 2009 and he remains living in our jointly mortgaged home and has been paying the mortgage alone for over 3 years now. We are divorced.
I keep asking him to file a change of parties form but I just don't seem to be able to get things moving. The property is in negative equity and he is self employed, the preparation of his accounts seems to always be his excuse for not getting this done although he assures me it is his intention to have my name removed from the mortgage.
Is there anything I can do to force this???
He keeps missing mortgage payments and this reflects on my credit history, it's so frustrating. Is there anything I can do?

Are you prepared to contribute to the shortfall if the property is sold?0

If only I could!
The background is while we were together he remortgaged us a couple of times to personally grow a small property portfolio so the negative equity is connected to the other properties he still owes in just his name. He built himself up a total of 2 extra properties which he rents and some land.
He says he has a plan to turn our property into a buy to let mortgage and then remortgage again in just his name but I don't know if this will work....0 -
Is there equity in the other properties?0

I think there is around 20,000 in one possibly none in the other and the land is mortgage free worth around 8,000-10,000.0

Is it a possibility for you to take the house on yourself?0

No, my salary would't allow me to do that, not even if I jointly tried with my new partner.0

Difficult to see what options you have at this juncture.
By the sounds of matters. Your ex's finances may implode in any event.
This would at least bring matters to a head.0 -
Yes one way or another!
Thank you.0 -
Has anyone been in this same situation and had a positive outcome? I'd appreciate any advice - legal if possible....
As far as I can see there are two possible outcomes, I wait and wait and wait for him to complete the forms or... I wait and wait, he defaults on more and more monthly mortgage payments and the property is reposessed leaving us both in a real pickle!0 -
Legal route to force a sale of the property is very expensive. With no equity to fund your costs. Not an option for you currently.0
