Among the debts that were included were a personal loan from HSBC bank that was solely in his name, but had a standing order set up to pay it monthly.

We could do with an Insolvency Practitioner or an 'undercover OR' to post on here. Us 'amateurs' can only advise so far....
But if it is in his name ( The Loan), why woud the OR say that HSBC are entitled to chase her just because she paid the payment ? She hasnt signed anything and certainly shouldnt be liable. I think the OR may have their wires crossed with this.
There is NO way she should be chased for a loan in her husbands name and she isnt bankrupt, no way. She should call her bank and insist that this standing order is cancelled immidiatley if it is on her own current account at the moment.0 -

That is exactly why I think they must write to the OR, so it is all crystal clear and is likely to be dealt with by someone more senior/knowledgeable at the OR's office.
Most OR's will put their own personal email add on any letters they send you. Mine hhas always responded very quickly with anything Ive asked via email, and anything she hasnt known she has found out.
That way you can mither and mither away and it doesnt cost anything, plus you then have it in 'writing'.0 -

Good point. If this can be sorted out in Zaphod's favour ASAP, without relying on 'snail mail' then that would be superb. It would give peace of mind one way or the other quicker.

True. But on some of the finer legal points an incorrect opinion can do a lot of harm.

If its a bank loan and its the same bank account, they generally do use SO, it saves them the cost of a direct debit !! they can transfer the mone internally for fre.. Another money making machine !!
You can also cancel a SO at any time, escpecially if the loan is not yours - as hopefully in this case !0
