Employer Forcing Meeting While on sick leave

  • It's generally not considered best practice to hold any form of misconduct investigation or disciplinary whilst an employee is off sick, but there is no law against it. If you are genuinely too I'll to cope with a meeting at this stage, you could get your GP to write a supporting statement to this effect, however, as some of the other posters have pointed out, you will just be delaying the action. If your health is up to it, it would be far better to attend and deal with the situation, having the threat of disciplinary hanging over your head probably isn't helping you to overcome your medical problems.     I have recently been dismissed for a very similar situation.

    I was off sick for several months with a stress related situation and was in a bad way.

    My employer requested welfare visits and I cancelled at the last minute twice, but asked whether I could visit their office. They then sent me a letter arriving on the 7th of December stating they had arranged a disciplinary hearing, citing Gross misconduct and unauthorised time off, for the 10th of December. I immediately emailed and stated that this was too short a notice period and the HR manager said she would get in touch as she was out of the office for a few days.

    I sent in a doctors note to cover me to the 29th of December only to be told that I had been dismissed in my absence! This was done by a company that works in the community with mental health issues!!!

    So now I am totally without income, my mental state has gone from bad to worse and I cannot get any help from the benefits agencies as I was dismissed!

    You could claim ESA until you get back on your feet if your doctor still thinks you are unfit for work.

    I would also suggest you seek some advice about the fairness or otherwise (legally) of your dismissal. There is a strict time limit of three months (less a day) in which to lodge a tribunal claim if appropriate.
  • Got to say that I feel they acted in an unfair manner and will seek out professional advice as I get myself on a more even keel.
