Debt Collection Company After Me

Hi last Friday my ex husband posted a letter through my letterbox. I opened it and to my horror C.A.R.S (Creditlink Account Recovery Solutions) had issued myself a FORMAL DEBT NOTICE and was writing to me on behalf of Budget Insurance regarding unpaid car insurance £133.27.

I have never taken out car insurance with Budget. The only explanation I can think of is that a long time prior to my separation (February 2005) my husband must have arranged joint car insurance on our car and had it put in my name with him as a named driver. However when we split up February 2005 he decided to no longer pay it.

The letter from CARS states that they have sent many letters to which none of them I have responded - this is the first time I have received a letter. This is most likely because my ex husband decided not to pass any of these letters onto me however he did do so with this letter.

The letter advises me that they have no alternative but to commence with a more Formal Debt Recovery process to obtain this debt payment, this could include the following -
1. Recommendation to our Client to issue a Registered Default Notice against you.
2. A Field Agent may attend your premises to collect payment


I immediately panicked and rang CARS straightaway and told them I do not live at the address they had posted letter to (my ex husband does), I have never knowingly took out car insurance with Budget and I have never ever received a letter from them due to no longer living at the address.

CARS told me they will send a "Web Message" to Budget advising them of what I have told them. They asked me for my current address which I gave to them and as yet I have not heard anything.

Can anyone give me any advice on this?

    I know that if you speak to national debtline (free service) they will give you a template letter to send them asking for a copy of the agreement that you signed.

    there was a good answer given to an old debt ie over 5 years ago, it may cover the letter you need to send re the agreement.

  • I had motorbike insurance with Bennets Insurance. I sold my bike and cancelled the insurance in writing before it was due for renewal but bennets want me to pay the £120 annual fee anyway!!! They have ignored my letters and set Creditlink Account Recovery Solutions onto me. This company also ignored my letter and phoned today but I didn't answer because I am unable to (mental problems). How do I get these people off my back? I sold the bike due to financial problems, I don't want to have to pay for an insurance i don't want.
    Please help!!!
  • my wife has had a letter to day....when i opened it it was from a company called mackenzie hall looks like a debt collection agency..askin for 300 pounds for an overdraft with the halifax bank in 1996!!!!..can anyone help please.
  • We've had trouble with Budget & Creditlink - we've just had the same letter as back2square1 has mentioned.

    Our story is an insurance cancelled by Budget (which, when queried, they told us we'd cancelled .. umm, no we didn't!) - They now claim we owe them £216 approx and have passed it to Creditlink.

    The worst bit is, we complained to Budget about their service and were also told that "the outstanding debt is suspended until the complaint is resolved" .. we've heard nothing and therefore is not resolved, and is in fact still in the hands of F.O.S.

    Not sure what to do from here! I have emailed Creditlink to inform them of the current state of play but fear it will do nothing.

    My husband had a letter from C.A.R.S a few months ago saying they were going to send the bailiffs to our house on behalf of 3G. They said that as he had ignored all previous contact, they had no other option. My husband had never had a 3G phone, and had never received any letters about the matter previously. I phoned C.A.R.S and asked for all of the information, and it turned out that the person they had on the contract had the same name but a different date of birth, and had registered the contract in a county my husband had never lived in. I telephoned 3G and spoke to their fraud department, and they looked into the matter, and confirmed that the contract was not my husbands and they contacted C.A.R.S informing them that they were chasing the wrong person.

    If you have never used Budget Car Insurance, then I suggest you double check with your ex husband, and if he denies all knowledge, then speak to the fraud department at Budget and get them to inform C.A.R.S they are chasing the wrong person.

    Hope you can sort this out soon.

    if you have no knowledge of the debt you need to send a CCA letter with a £1 postal order. If you do a search of the threads there are templates about.

    But do not sign the letter - just print your name!
