Hi,
I went into a currys store on new years day and 'bought' a tv.
The item i wanted was not in stock, but i was told by the salesperson that more stock would be coming into the store on either Thursday (3rd) or Saturday (5th) i would be called to come and collect then. This seemed fine.
No call Thursday, so i contcated call center who told me theyd email the store and ask them to call. Nothing!
No call Saturday, so again i rang call centre, same response, same result, no call!
So fed-up i drove to the store today and was tole by a customer services 'manager' that they hadn't any stock and now could not confirm when any would be avaialable. He simply said, "we cannot deliver your tv. Would you like a refund? "
My query is if i have paid for an item in full by debit card, do the store not then have an obligation to deliver that item, despite whatever 'system' issues they have had, or should i not be entitled to recompense, or at least an offer of an equivalent spec. tv if they cannot deliver the one i ordered. The 'mamager' said this was not possible.
Please help.
I have already sent an email to 'customer dervice' stating i want a firm delivery date for the tv or an alternate product.
Thanks.

You have not been "mis-sold" a TV, you have merely been given advice, which turned out to be incorrect, as to when stock would arrive. They can't conjure up your TV out of thin air if they don't have it. Take the refund and get the TV from somewhere else.0

If the product is not available then the contract is frustrated. Assuming the refund has been issued, you have been put back to your original position, which is what the retailer is required to do in such a situation.0

You are entitled to a refund and thats it.
They cannot give you something they do not have, they are not obligated to give you an equivalent set, you are not entitled to any recompense.
Refund and re buy from another retailer.0 -
Why on earth does someone go into a store and pay for something that the store does not have? Especially with a debit card.
Just think, what would have happened if you had done that with Comet the day they went bust?
No TV and no refund.0 -

No TV and no refund.
You can still chargeback with a debit card.
If you can foresee the future (as you indicate) what's the lottery numbers for saturday please?0 -
lottery numbers for saturday please
Any 6 from between 1 and 49 inclusively.
It is a lot easier to get a refund to a credit card than a debit card as numerous posters have posted about problems getting a debit card payment refunded.
I never use a debit card for paynent, always a cashback credit card.If you can foresee the future (as you indicate)
even if I couldn't foresee the future I still would never have paid for something in a high street store, or any other store, for goods that were out of stock with a debit card.0 -

If its a Visa debit card then you have the same chargeback protection.
Only diffrence is CCA. Which would not come into paly here even if currys did a comet.Never ASSUME anything its makes a>>> A55 of U & ME <<<0 -
Wow, silly me for thinking again that this was a forum for advice. Thanks for those of you that did offer a sensible opinion. As for the others, really i think you should find something more productive to do with your time.
Is it really the case that a shop can take my money for an item and then a week later tell me i cant have it??
Surely this is ridiculous??
Maybe i was foolish for using a debit card, but i still cant see how they can justify not being to provide what i have paid for. Never mind the fact that if i hadnt had gone into the store today they might not even have told me about this eventuality!!0
