Another Welcome Car Finance Mess

Hi all, this is with regard to my brothers car so the figures wont be 100% precise but see if anyone can help.

Bought car in 2001 for approx £3500 HP.

has paid about £6000 in total, but started to default last year. Asked them for a reduction in the monthly payments but apparently they fobbed him off with some excuse about legislation changing which didnt allow this!!!

Sherriffs Officers turned up today to serve court order for repossession of car (fair enough its off the road any way and probably wont be road worthy again). But he is also being pursued for another £5200.

Is there anyting he can do? I'll try and get some clearer details.

BTW we are in Scotland so its Scottish Law

    jesus H C, what a mess. Does he have any other debts/ assets? cos they will take them next! Send him to CAB soonest.

    Does have some other debts not much though.

    No real assets to speak of.

  • Oh Welcome Car Finance!

    I got a car through Welcome. To cut a long story short the car was a dudd. Welcome said if I got all the repairs doen they might meet me half way. I said I was entitled to a full repair refund but they refused. After a long battle they secured the debt against the house and then continued to harrass me for payment but on their terms.

    Again cutting a long story short I went backrupt - and who was the first firm to approach me once I was discharged - Welcome!

    Be very aware of this firm at all costs.

    important question. how did your brother get to Welcome Finance? did he use a broker such as Guaranteed Car credit? and did he add the usual insurances on to it? If he did I think I can resolve his problem for him.

  • I am about 99% sure it was bought through 'Yes Car Credit'

    I will double check

  • I have just phoned him.... the car was purchased at a 'Yes Car Credit' Branch and there was insurance added on.

    Dont know exactly what, but bruv is looking out all the paperwork for me to see.

    In reply to your request, Yes there are one or two issues here.
    They are not loopholes but points of law.
    Points that many lenders get wrong.
