Agency Workers rights after 12 weeks - Anyone familiar about it

    Can I piggy-back on this thread for a second - sorry OP.

    I've been working for an agency for 9 weeks now and it seems to be ongoing (touch wood!). With regards to annual leave, I am required to accrue the days BEFORE taking them while FTE are given an allowance to be used as and when (which obviously would be preferable). Does anyone know if I'd be entitled to the same after 12 weeks?

    I don't understand this but why do people ask for assistance then when they have the answer never come back and update!!!!
    This information could be a benefit for other people and it keeps happening.
    A simple yes I got it or no I didn't isn't hard is it since people made effort to try and assist in the first place!!!!

    To be paid at the time you take it, you must have accrued the holiday.

    If at some point you want to take more holiday than you have accrued, ask your agency whether they would pay you later. That is, take the holiday unpaid initially but claim payment later.

    You do realise that if you create to much of a fuss they may just say bye?

    Also, there are exemptions as far as I am aware, something to do with the swedish model? Google it.
    If that's the case, perhaps not pushing so much, may be ask once and if they don't give it keep it quiet until you cut ties with the employer. Then you can perhaps backclaim e.g. court case on the basis of the guideline?

    Sorry for hijacking this thread but I asked one of the posters on here (#10) for help as my cousin was going through a similar experience with AWR. With her help and guidance my cousin has been given everything she's entitled to plus back pay ...Same pay and holidays as permanent staff ect ect only difference she's paid weekly.
