Hi in a mess and welcome ,i think i remember someone asking ages ago about this i will have a look through the old threads for you and see.

if you have a contract of employment have a look to see i it says anything in it about bankruptcy .

Or do you have a union you could check with.

have you looked at any other options rather than bankruptcy ?

if you eel able to post your SOA then we could take a look and advise you .

  • Hi iv found this
Policemen and Accountants are not allowed to go bankrupt (although in the case of the Police Force this rule is beginning to be ignored I believe?)

Some employers may conduct a credit check but they will be looking for a bad payment history such as CCJ's or Bankruptcy.

Policemen often go for IVA's rather than bankruptcy so that their future in the Force is not affected.

"Force Welfare Departments are best placed to provide financial advice. Contact with Welfare may be made directly or via staff associations, ‘first contact’ officers or any other person(s) within the organisation with whom the officer feels comfortable. Officers should be made aware that disclosure at the earliest opportunity would provide them a level of protection against their increasing vulnerability and also the best opportunity to manage their debts successfully. Bankruptcy will not in itself be seen as a discipline issue unless linked to criminality or willful neglect. A bankruptcy order is a lawful process to discharge debt.

I've read a lot that says that police are definitely one of the professions that can't go bankrupt and keep their jobs, like solicitors/ those in the legal profession/ banking industry. I'd be interested to know if this has changed.

  • Hi there,
My OH is in the police and has been told he would lose his job if we went bankrupt, sorry....it may be different across forces though. Sorry you are having a hard time right now, I hope you find a way to sort it all out. Good luck.

    In a Mess.

I have personal knowledge of a police officer going bankrupt and continuing to serve in his job.

Liaise with the Police Federation if you intend going along this route.
  • Thanks for the advice everyone I will check with my Police fed rep re this and let you know.

In a mess - I don't think you can go BR, but you can get help through the Federation with getting you out of debt - they usually get you a free solicitor to help you with anyone chasing you for money and I am aware of a Poice Officer who went on a 5 year Debt management Plan. Get in touch with your Federation Rep as soon as possible.

    Good luck!
