My wife's brother tells me that as he lives and works full time in Cape Town but is employed by a uk company and is paid into a uk bank acct he can claim every single penny back on his income tax seems abit unfair to me if true ill agree the majority of it but all of it?

I've don't know his full circumstances but it would seem reasonable that some-one who lives and works abroad would pay no taxes in the UK.

This is tricky without knowing more detail!
Reading what I can from the original post I would assume the OPs wife's brother is non-resident in the UK. However he would still be subject to any taxable income arising in the UK. Hence if his UK employer is paying his salary in Sterling into a UK bank I would expect this to be subject to UK tax.
It is a very tricky area with residency, the double taxation agreement between UK and South Africa, source of income etc determining where taxation will take place.

I'm told he is paying no tax at all in SA however one thing that doesn't tie up even to me is that he says he's getting taxed at 42 percent on his forces pension he also tells me that the rules are all changing very soon it's rumoured to stop this situation in claiming all your tax back I just think its wrong0

maybe the full facts would help a little0 -
Just sounds like a severe case of sour grapes to me, I doubt if there's any way the OP would be able to get hold of the full facts so we will never know what the tax situation really is.0
