  • PayDayUK are still refusing my offers and coming back with a minimum payment that they would accept of £15 per month, despite several emails telling them that as per my financial statement, I can not afford this amount and also quoting Section 6 of their code of practice as above etc...

    There may be something on your SOA which is too high or is unneccessary that they don't want to mention but could be removed to enable a higher payment.

    Your DMP runs over 10 years. That's quite a long time. Most creditors are looking for DMP's to run for less time than that.

    Do you have assets? Could they if they wanted to get a CCJ and secure the debt against your property?

    It's interesting reading your past posting history. Nov 2011 - Just one more payday loan...despite the advice of the posters on here.. Then July 2012 - An Amigo loan despite the advice of posters.

    The Amigo loan will be paid in full and on time by your guarantor so the token payment can be removed from your SOA and you need to set your guarantor up as a creditor.

  • I may have to look at my SOA then, see what can be amended and accept their offer of £15 otherwise they are just going to keep hounding.

    I don't have any assets, no car, rent my property and no savings.

    I know I got down to 1 loan in November 2011 but all went downhill from there, my own stupidity, but hey, this is a judgement free forum right?

    Have you told them that you will be making a complaint to the Financial Ombudsman that they are breaching their agreed industry code of practice and OFT guidelines?

    Tell them that you are making a formal complaint about the breach, and that you now require a final response that you can take to the ombudsman.

    If you end up taking it to the FOS, then that will cost PDUK £500 in fees. i.e. it will cost them as much as you owe them, and they will never get that money back whether the FOS unholds your complaint or not. ;)

  • Update: After a little e-mail war with PDUK, I have given in and accepted their £15 a month offer, they have provided bank details and SO to be set up for 20th of each month.

    Am now in an e-mail war with Pounds2pocket, my original offer was £12.59 per month, they came back saying they will accept £50 per month. I have replied stating that as my financial statement shows, I am not in a position to pay £50 a month and would be willing to step up to £15 per month but no more. If another refusal follows, I will play the "comply with CFA rules or i'll complain" card.
  • Pounds 2 Pocket have gone back on their word, does this warrant a complaint to the CFA??

    Basically, after a lot of toing and froing via e-mail to set up a suitable payment arrangement, they finally agreed to £15 on the 21st of each month, so I gave them my new debit card details and they confirmed the dates that they would take the money out my bank.

    On Wednesday, my fiance put £30 in my bank for me to later transfer to our house account but when later on came, the money had gone, it didn't show on my statement straight away but on checking this morning, Pounds2Pocket took £28.94 of it!!

    I have e-mailed them telling them that I am not happy that they have gone against our arrangement and that now they have taken that, I cannot give them £15 on 21st January but what else would you advise I do?

    In other news, Argos have agreed to £5 a month, PDUK have agreed to £15 a month and Wonga have agreed to £6.66 a month.

    Still waiting to hear from Very, K&Co and Tesco Bank - have sent reminder letters yesterday.

    Never ever give you card details to creditors or set up a direct debit. I assumed you knew this. They will variably abuse it and take more than agreed.

    Demand that it is refunded or you will complain to the FOS, OFT, etc....

  • I have been requesting bank details from creditors to set up standing orders and have got details from Wonga and PDUK, awaiting details from Argos but Pounds2Pocket said they don't have bank details to send me and said they would use my debit card, which was one I reported lost so gave them my new card details.

    I will await their reply and then say that I have sought advice and would like it refunded, when I will then pay their £15 agreed payment, and if it is not refunded I will complain to the CFA that they have gone against our agreement and put me in a worse financial position by taking more than agreed.

    Of course they have bank details they can give you.

    They are fibbing so they get your card details and can do exactly what they have done. :angry:

    Complain to the CFA if you like, but 1st of all tell P2P that you will be complaining to the FOS and OFT.

    Complaining to the FOS will cost P2P £500, which if they have any sense they will want to avoid. The OFT have been warning PD lenders against abusing payment arrangements, so P2P will not be too keen on that either.
