  • Fronting a deal for a third party is considered fraud and is illegal as the first paragraph in the link below explains.

What you have done is deceived a finance company into goving you credit when it wouldn't have done so otherwise.

Perhaps the finance company won't entertain you trying to to cancel the agreement because they do not have an agreement with you?

    Utter tosh!

To commit fraud, you have to have the intention of depriving the rightful owner of property or money, ie Wrongful or criminal deception intended to result in financial or personal gain. You haven't been given credit - your mother has.

However it is considered fronting/accommodation, this is considered a fraudulent finance application and if the lender becomes aware they will terminate the agreement...As for the personal gain, there definitely is a personal gain, you have acquired a vehicle where the main driver is an unacceptable credit risk.

That said, fronting happens all the time (a partner or parent used to obtain the finance, whether it be due to adverse credit or simply to acquire a lower rate), and most times is not discovered by the lender and the agreement runs to term.

The info the sales guy is giving me for the new car I'm supposed to be getting is:
Do not contact the finance company regarding the registration document
It being registered in my name is illegal
Not sure if that's me or the guy who sold me the car!

You begin by saying you are giving the car back because the cost of petrol etc has made it too expensive, but then say you are getting a new car, sounds like you want to get out of the deal with the original car and take on a new one, how can you now afford petrol if you could not before, and if you can, why get rid of the original car. Petrol costs the same amount no matter which car you choose to drive...

It costs the same per gallon, but the total petrol spend in a period also depends on the MPG of your car.
