Hello everyone....
Complete newbie here....
Just lloking for some advice really...
I have to attend court tomorrow to try and stop Natwest/Shoosmiths from putting a charge on my house (jointly owned but debt in my name).
My partner and I are in a DMP, that has not been doing its job... my partner set it up and I now realise that the company has not been doing its job very well....
They are claiming £29k (even though the actual amount borrowed was just under £15k.
They have been accepting payments monthly, although very small as I have been on maternity leave.
We have other debts also (all have been ok with the arrangement) and owe approx £55k :0(
Can anyone offer any advice on what I can say to try and stop this charge.

Are you with payplan or CCCs? if so have they given you any advice.

Unfortunately not... we went with a company called IDM.... my partner arranged it while I was pregnant with our first child and I didn't realise that he hadn't looked at other companies... he just searched the internet and picked the first one on the list... Can you get into see CAB for some advise?,i know it's short notice but anythings worth a try.
We started our Dmp this month and our debt is over 50k i'm quite expecting for us too to go to court to have a charge on our house too.
You are with the best forum ever here,there is always someone on here you can share your problems with.

I will get to the CAB at lunchtime to see if they offer any advice.
Sorry to hear you are in a similar position, but it is nice to know I am not the only one iyswim....
The thing is... we don't live luxuriously at all... all four of us are in a one bed starter home.... (two little girls, one 3yr old and one 6mnth old).
What is really scarey is if they do get this charge the could go to force a sale... then we really would be in a mess...
If it wasn't for my girls I would just crawl away and hide :0(

Hi, I hope you don't take this the wrong way, but do you not think you may be better off selling your one bedroom house and getting a coucil home that will provide more reasonable living conditions for you all. Plus you may qualify for help with the rent?

As we own our own home, we have been told by the council that if we sell up then we would be making ourselves homeless... therefore they would not help us.... unbelievable but true unfortunately....
We are on the list in the lowest band but they have told me that as we are still "together" i.e. not a single parent family, we both work and we own the house, it will be years before we even get close.
Everywhere we turn at the moment is dead end after dead end, if the natwest force a sale, then the council will step in and help, but I am scared stiff of my girls having to live in temporary accommodation... You just can't believe the logic behind council decisions sometimes, it makes your blood boil!

Tell me about it.... it really infuriates me....
I have actually been told by an ex-housing allocations worker that if I ditched my oh and stopped working I would be about £300 a month better off...
My oh and I are a typical couple we have our off days, but when push comes to shove, he is my rock and I would never be without him, so they can stick that idea...
I would just love to know what is going to be said tomorrow... and if I have a hope in hells chance of getting them to knock this charge on the head... I can afford to pay them more now I am back at work, but as I understand it I need to pay the same percentage to all the other creditors, surely they must know this???

I really cannot be of any help apart from either ring national debt helpline now or go to see the CAB.
Sounds like you were let down by your DMP and maybe if you can prove that your intentions were good the company you choose wrong the courts could be ok or CAB or some expert will be able to fight your case.
Please do something now rather than worry armoured with facts we can move mountains and I hope you can too.

Hugs. I think the charge only gets applied if you sell the house so its less stressful than it seems. Move your DMP to a free provider or run it yourself. Its hard at the start but we are better off now than when we were running up the debt because our money is well managed.Barclaycard 3800
