my son has his esa paid into my husbands account as he don't have one of his own.he is due to be paid into the account on Friday.the problem I got is yesterday my son robbed me so I have reported it to the police and they are going to arrest him,i am not allowed to have any contact with my son the police have told me .I want nothing to do with him ever again anyway as this is the second time he has don't this to me in 1 year.i phoned the esa helpline to ask if there is a way I could stop him money going into my husbands account I explained the situation to them and they told me that the only person that can stop it going into the account is my son.so I asked them what should I do with the payment on Friday and the dwp replied to me its up to me what I do with it and if I want I can keep it to replace towards what he robbed off me.i am not going to keep it but I also cant give it to him any advice what I can do please with the money as I have no idea

Can you husband not meet your son to give him the money, and to tell him to arrange for it to be paid elsewhere (such as a Post Office account)?0

none of us are allowed any contact with him and if my husband sees him he will probally kill him0

In that case you will need to ask the police what they suggest you do. I can't see why your husband cannot contact him, unless he is a party to the incident?0

yes he is party to it as he was the one to recover the stolen item off my sons landlord as he was trying to sell them on gumtree0

How about you take the cash out and give it to the police station (getting a receipt). That way you are covered, you have proof you handed it over, he can collect it etc.
Then tell your bank that you won't allow any more payments and if your son doesn't get off his backside and change the payments, he gets nothing.
Sorry this has happened to you, it's hard when loved ones betray you and let you down.0 -
that is a good idea I will take it to the police station on Friday.he has done this to me twice in 1 year now the first time I took him to court bu7t later forgave him but this time hes had his chips0

does your son have a solicitor? if so the payment should be given to them to hand over to your son.
also the dwp customer line is lacking in propper advice.
whilst your husband is the acount holder, he can effectivly state to ESA that he no longer gives ESA permission to make payments to this account and to delete his account details from their system that way they will have to cease payment of ESA and send a letter to your son at his nominated address for accound details, in times of being homeless his postal adress can be the local jobcenter, aswell as girocheck payment at the JCP office.0
