I think there is a 26 week sanction, best thing would be if the OH grovels and asks for their job back :)

    Ask the jobcentre, or CAB.

Sanctions are up to 26 weeks but are not always made at the maximum. It depends on the circumstances.

JSA may be sanctioned, however a benefit claim may be made pending any enquiries into the reasons for the job ending. Even then, any sanction may not mean that the whole entitlement is lost.

What some people do is change the claim around. IE the person who wasn't working makes the claim to JSA and the person who was working looks after the kids.

Ultimately, whoever makes the claim must be the person actively seeking work and willing to work. If the claim is made in the partners name and she sign's on, she must be prepared to work.

Claiming JSA is not a paper exercise. There are responsibilities too... ie the intention to work ! It's not just there to generate an income.

my OH was in the same position 4 months ago when he had to walk out of his job as it was a choice between a good job reference if he left or nothing if they had to finish him so he opted for the first. so when we applied for JSA we told them this and we still received money till they looked into it, luckily it worked out and we received JSA for 3 months as he has a temp job now.

Hopefully this will be all sorted out by now. Sanctions are not automatic on leaving voluntarily. An independent decision maker decides after looking at the reasons for leaving the job so it's essential to put all the relevant details and facts on the form provided.
