Non-payment of DER

Just a little update on my last thread (when the DER had been revoked after the NRP contacted the CSA and asked to pay via DD).

Apparently, the DER stayed in place awaiting the receipt of a DD mandate from the NRP. This still hasn't been received, 5 weeks on from the date it was agreed.

The DER should have pulled for the first time at the end of last month, and received on the 19th. It still hasn't been received and they don't think it will be, now. This can't be chased until the end of the month, either, so it would seem that the next payment won't be going through at the end of this month either. That makes the arrears £1700, by my calculation :eek:

There's nothing anyone can do, I know, but I just thought I'd update my story (so far!) here. This board is the only place where it seems there are other people who understand how it feels to have this happening x

I don't understand why it can't be chased until the end of the month ~ if the DEO didn't pull but should have been received by the 19th I don't see why this cannot be chased up now? The employers are obliged to send in the previous months payment by this date ~ this date has passed so action needs to be taken to find out where the payment is or why it wasn't sent.

As you say this payment will now just probably get banged onto arrears ~ not much help to you now!

It can't be chased because the case worker is away for a fortnight :rolleyes:

By the time she's back, the next payday will have passed too

I would certainly suggest that you telephone them again and speak to a supervisor ~ caseworker off for a fortnight ~ Is your caseworker the only member off staff in the CSA ? I think not, this is a disgraceful excuse.

I am sure there is another member of staff that can telephone his employer asking where the payment is ! ( I mean how hard can this be??, at least you would have some sort of answer ) Your caseworker will be a member of a team ( and believe me there will also be more than 1 team) If not ask the supervisor (EO) to do it for you.

I've tried that. The case worker dealing with it is the supervisor, unfortunately, and no-one else will touch the case. It did have a different case worker, but the case was handed over to this one after they discovered they had made a mistake.

I'd like to complain, too, but I have only my side of the story, if that makes sense. I know there has been some maladministration, without which the problems might well have been sorted by now - as far as I can deduce, the fault lies mostly with the NRP, althouth the CSA has played a significant part in it. I don't know the exact details, though, because his side of this is obviously not told to me (at least, not overtly!) in order to protect his privacy.

There will also be more than 1 supervisor ! Imagine if all jobs just stopped because people went on holiday, I would ask to speak to the HEO (supervisors supervisor) and make a formal complaint.

If the collection is by DER rather than DEO i assume the NRP is in forces. If so then the CSA cannot actually enforce the DER in the same way as a DEO., the forces payroll is notoriously slow in imposing the deductions and the caseworkers have been told not to chase them. Feel free to talk to a supervisor but the CSA does not have any enforcement powers over HM Forces so you may just have to wait.

Do you know if the NRP has been deployed to an Operational area such as Afghanistan/Iraq etc? If so then the DER may not actually be imposed by payroll until he returns.

I know they can't enforce a DER. He isn't deployed abroad at the moment, or working in any situation where the 'stress' of a deduction would impact on his work. He is mostly going out, drinking his childs food and clothing money away and rubbing my nose in it at the moment. The amount they are trying to have removed from his wages isn't over the limits imposed by the branch of the forces he works for either, so there's no real reason not to comply with the DER.

One thing to check is to get a caseworker to ensure that the method of collection is actually set to DER. If it has been set to DEO in error then the Forces payroll will most likely just bin the paperwork. It is the very first thing i check whenever i take a call relating to an issue of this nature, in my experience it is not an uncommon error to have been made.

Worth getting it looked at, sometimes the easy/obvious/simplest things are the ones that get missed and therefore easiest to get corrected.
