BT Debt, Need Help & Letter

Hi everyone
I would appreciate some help, a year ago i had a lodger here who i rented a room out too, she got her own BT line put in her room, but in my wifes name. She moved out, i cant locate her at all, and the bill has been passed onto an agency, and they are calling daily asking for payment of 350 pounds for a BT bill and internet that was never used or set up.
The charges were half the amount, and they were advanced charges for 3 months use of the internet and connection, the rest are other charges added on when the lodger did not pay.
I have had a BT phone line here for 15 years without any problems, i would not want a second one, but the agency do not understand this, all they can see is a bill from this address and they want there money, they are threatening court action and all sorts.
The service was never used or set up, nothing was signed, it was set up over the phone apparantly.
As you can imagin its getting a little stressful at this point, and its been going on for a year, ive said to them that i would like my day in court to prove its not my bill, but they never take me to court.
I was told if i come to this website, that i can obtain a letter, which i can send to the agency or BT, registered mail, stating its not my bill, and for them to prove it is with a signiture? And they then have X amount of days to prove it, or the bill is void? Is this correct?
May i please have this letter and instructions, so that i can print it, and send it.
I do own this house, so when they threaten bailifs and court action, it is quite worrying.

Did the lodger use the phone for calls and or internet. Why was it in your wifes name cause she will now be liable for the debt. the amount has problem gone up due to admin fees over the last year.0

Surely if its in yr wifes name then you may not have a case that it is not your bill.0

How was it set up, was it set up over the phone? Do you have any idea of the date. As all calls are recorded.
There is a board on here for telephones i am not sure what to say other than good luck and maybe you may able to find the page you have been advised to look for.You can touch the dust but please don't write in it !

Yes, it was set up over the phone, so nothing was signed at all.
I need the letter that i send to the company, that gives them X amount of days to send back signiture proof that the debt is ours, then it becomes void (i think).0 -

Frankly, though, the chance of you not having to pay this will be at best very small, unless you report it to the police. They will have a telephone recording of your agreement, and I doubt that this is covered by the Consumer Credit Act as I would have thought it is covered by contract law, not a credit agreement.

I dont mean to sound harsh but if its your Stepsons GF that run up the bill and the account is in your wifes name I dont fancy your chances of trying to persuade them without getting the police involved.
Also it is very unlikey to get to the stage that Bailiffs get involved. the problem is that it could damage your wifes credit rating if they send a default notice anyhow.
I really dont know anyway forward that doesnt involve contacting the police as a fraud has been committed.

I think if you are to take this further to clear your name, you will need to contact the police to gain a crime reference number, this will cover you should any further action be taken.
To be honest it is tough on the girl that left, she has left you with all of the worry, etc.
You need to protect yourself first and foremost, and worry about your son's ex another time.
