Ex refusing to pay for a loan with my step dad as guarantoor

  • get the car fixed and sell it!!!!! pay it to your stepdad. he is now legally responsible for the whole amount outstanding. doubt the courts would help...he signed a legal doc and should have known what he was signing it for. harsh, but thats why they use guarantors.

    Whilst legally you are not required to pay anything towards the ex/stepdad loan, if the car is in your name and you have no use for it perhaps you could sell it and give the money to Stepdad for him to partially recoup the payments he will need to make.

    Is stepdad keeping on top of the loan repayments at the moment? If not his credit file will be affected.

    Your mum cannot take this to small claims court as she is not involved with the loan.

    With regards to stepdad trying to take ex to court - by signing to be a guarantor he agreed to repay the loan if ex did not. The only likelihood of him being able to take ex to court is if he has a seperate written agreement from ex that in the event of ex defaulting on the loan he would pay back the amount to stepdad personally.
    Without this then the courts would assume that by signing

  • and what he did/didnt do, said/didnt say doesnt matter a toss in this instance. nothing will change the fact that your stepdad should have known what he was signing. and now he is legally responsible. sad when this happens, but always read the small print. especially the very small print.

    From the original post it is apparent that the ex knew exactly what a guarantor loan was and that the step father obviously did not.
    Let this be a grave warning to anyone proposing to be a guarantor to a loan. Make sure that you know exactly what you are getting involved in.
    I can afford anything that I want.
    Just so long as I don't want much.

    £10k for private renting yet you are not sure? How did he justify asking for this amount to you, 'I'm going to ask your stepdad for circa 1 yrs private rent up front? I'm puzzled. No way does that add up and I would never have handed the phone over for him to ask without knowing EXACTLY what it was for. Your ex is liable, left, right and centre and I wish your stepdad the very best with this.

    How sad, I think by the sounds of it your ex is a con artist and is trying his best to shirk his responsibilities. "£10k for private rent" that would pay my mortgage for 3 years!
